    Hi

Just received a reply from LSC regarding the £1300.00 owed to them due the fact that they revoked the legal aid cert. They now say that the debt did not occur until they revoked the certificate in Sept 2011. Can anyone tell me if they can do this or are they just chancing their arm. They have also extended the time to return our income details for 2005, but I dont even know where I could go to find this out anyway. So really I am no further on.

It certainly looks like they are chancing their arm here. At the very least, this arbitrary decision to revoke in Sep 11 may be an attempt to circumvent the Limitations Act, but in doing so, I would suggest that there may be an abuse of process.

I suggest you get yourself a free consultation with a solicitor (house insurance maybe?) and ask them to investigate if there has been a breach of the relevant rules (could be criminal or civil procedures and I don't really want to know which you were subject to).
The problem is that there are different Regulations dependant on the nature of your case, and someone with detailed knowledge would need to look at your individual circumstances and make a determination.

I hope I don’t sound nosey but do you work or are you on means tested benefits? If so a quick chat with a small solicitor should sort this out. The reason I say do you work is that the cost will be covered by legal aid. (not being funny) but a solicitor will probably have come across this but they’re not going to help for free.

    Hi Bingo Bango

I have emailed my solicitor this morning & I am awaiting a reply from him, but I also think that they are chancing their arm, I certainly will not go down without a fight. I dont even know where to start looking for income information from 2004/2005 & they have said that SSA wont give them any info

    Many Thanks
