Problem with David Lloyd/ARC credit management

Hello

My DD and her partner joined David Lloyd in Jan this year. DD became unemployed and the direct debit to the gym went unpaid in May(£100). They were then contacted by ARC to say that they owed £490 each, the letters were threatening. They agreed to pay at £100 a month and have continued with this. WE have just found out about this and wonder if they need to continue to pay ARC just short of £1000?

    There has been a recent court judgement about unfair terms in gym contracts but I do not know whether this will help in your DDs circumstances.

    So, how long is the contract for?

    Is it a joint/single contract?

    What are the terms for cancelling the contract?

    Can the membership be transferred to a friend?

    If you can find out the answers to these questions we may be able to help further.

    Don't get too excited though as gym contracts are notoriously difficult to break.

    Hopefully others will be along to offer advice/their experiences.

    Have a look at this link.

    Although the rulings relate to Ashbourne it does say that all gyms are recommended to take note of the rulings and amend their contracts.

    Although there is no obligation to do this it might be a negotiating point when dealing with David Lloyds.


    You will definitely need a copy of the contract to find out which specific rulings relate in your DDs case.
  • Can anyone help, my nephew has had the same issues, even after telling them it wasn't financially viable to join as he wasn't sure how long his employment would last, and after asking them for a copy of the contract it seems they are unable to produce it, what should be our next move???
  • I used to work in credit control and although I look at things from another perspective I disagree with gyms playing hard ball with customers who are genuinely in financial straits.

    1/ Drag it out

    Put all correspondence in writing and ask them to do the same. Then start asking them for information that you know will take them time to produce. i.e. "I would like to see a copy of my contract" or "please send me your terms and conditions" etc etc

    When you get a reply from them then don't write back straight away-wait around 4-5 days then send your letter back (second class of course).

    2/ When the point one has been exhausted then simply offer to pay a nominal amount each month e.g. £ 5 a month EVEN £ 1 a month citing financial hardship. List all your expenses and incomings for the month ensuring it looks suitably bad. They will have to accept offer of payment.
