Advice on CSA needed.

Hi guys,

Basic background.......I'm on a nil assessment at the moment as I am a full time student, however I am currently paying arrears back on a weekly basis. My child (16) has now moved out of her mums to stay with her partner, and I am considering looking for a P/T job. I'm basically wanting to know how things would stand with the CSA if I find a P/T job?

Thanks.

Well your arrears have to be cleared 1st, they won't stop (and they should not change) however your nil assesment status may change, above £200 net per week attracts around 15% CS contributions.
  • Thanks for the reply, but would I still be liable to pay anything other than the arrears due to the fact my daughter no longer lives at her mothers?

Would my arrears that I pay weekly increase if I found P/T workeven though I'm still doing a F/T college course?

It is difficult to say if you would still be liable, technically no, however if the PWC is still officially so, then CS contributions would be due, if the PWC is still recieving CB etc and the child still qualifies then yes, CS would be due. Your arrears would not increase as they are in the past.
  • Am i correct in thinking your basically saying if her mum is still claiming CB....even though my daughter has left....then I'd be liable for further payments???
How could that be, surely my ex shouldn't be claiming CB!

The other thing I'm unclear of is the working P/T while being a F/T student....I know being a F/T student means a NIL assessment, but is that still the case regardless of whether I take on P/T work?

Sorry for all the questions but I cant find any answers anywhere.

    Thanks again.

What you don't want to be doing is stressing yourself out over loopholes, expect the worst and hope for the best :o
I know there are frequent visitors here that will be able to clarify your position, but to be honest, my impression is that males are not too welcome on this board :(
But yes if the Mum is claiming CB then CS is still liable, you will only have more headache trying to prove that the QC is not living with Mum. As an NRP myself, I must confess CS payments soon become run of the mill and lifestyle soon adjusts to incorparate them, holidays fast cars and other social pastimes are still possible, and that is after ceasing to do overtime
  • Ah I see, well thanks for the help DUTR...it's shed some light on some things.
  • If the child has moved out then regular maintenance should stop, but as mentioned, it might all depend on whether the PWC is still claiming child benefit or not. Is your child still at school or in education?
  • My son is currently in further education till June 2012 and is due to complete his 3rd year of A levels due to him faling his 1st year after leaving school. He is 19 on the 23rd February 2012 and i am led to believe thats when i cease my CSA payments to him. Could someone clarify if this is corect as i am led to believe that because he is still in further eduacation (albiet a year more that he was intended to do) my payments will finish in July.

Currently CSA stops the week after his 19th birthday. This is even though child benefit can continue up to 20 if in qualifying education
