hi....can you not obtain your reports from the Credit Reference Agencies?

These should list your [current] creditors...any missed off won't matter to you in the end, because the debts will be included in your BR.

    Same with old power bills.

The OR won't necessarily require bank statements, as these can be obtained from the banks themselves.

Surprisingly, all you really need to take to Court are the relevant legal forms...any mistakes will be rectified with the help of the Court staff.

The Court itself does not handle your financial affairs.....it simply grants your petition, [on the Judge's stamp], thereby handing your financial affairs over to the OR.

[Usually] on the day, you will speak to the OR's office on the phone [at Court]....you will need an up-to-date balance on the bank account you are using for day-to-day living.....explain what this money is used for....the OR will inform you of whether they have an 'interest' or not....usually not...

The paperwork you mention [or lack of it] will be needed for your reference come the day of the OR's interview....

Basically it is about assisting the OR's rep to investigate your financial affairs.....makes life easier for them if they actually have some info......but I suspect they have proceeded in the past with a lot less info than you have to hand.

    The OR is not judgemental.

BRO's keep the restrictions in place...but....[I assume] will not apply in your case....

As for your views on your financial behaviour? Well, most of us have been there at some point, so they are far more commonplace than you might imagine.
No, I don't think all other drivers are idiots......but some are determined to change my mind.......

How do I prove what the debts were for? I can list who I owe and how much but cant remember what happened last week with stress let alone a few years ago. Don't worry about proving what you spent as it's so long ago and you've been on a DMP trying to deal with your debts since then
As I have deserted my old house, how do I know how much I owe gas/elec to put on the form without giving them a forwarding add for the bill??? As Alistair says, this should show up on your credit reports soon. Send off for the Statutory reports for both of you a couple of weeks before going BR. If the utilities don't show up for some reason then you can estimate the amount based on past bills plus arrears.
How many bank statements do they usually require??? Usually 12 months but again, don't worry if you don't have them or are unable to print them off online, just send what you have when you are asked for them.
Does a BRO/U extend discharge or just keep the restrictions ongoing???
Am I best copying and sending documents into court on the day of BR such as tenancy agreement, bank statements or wait to be asked???? Wait to be asked. My BR forms did ask for a copy of my tenancy agreement to be included, so I did that and then sent everything else to the OR once I received their letter informing me what they required.

Not necessarily, all Courts work differently. I spoke to my OR's office briefly from a private room in the Court building. Other petitioners are sent home to receive a call later that day or within a couple of days. Oops, sorry Alistair, you did say 'usually'.

Mandy - I was on a DMP for 5 years prior to going BR. I thought I had kept the last statement for all my debts and sent those in where they existed. Some of the DCAs had started sending statements too, so they went in as well. You just send whatever you have.

As far as what the money was spent on, I too didn't have much of an idea as it was so long ago. But I knew I hadn't blown it on expensive holidays or a super dooper stereo, so it was just general living expenses, living a little beyond my means for many, many years and that all adds up over time.

I also consolidated a couple of times over the years. Thankfully my loans were covered by insurance so were paid off when I went off sick. So I didn't need to mention those to the OR as they were (8 years) long gone.

How's the new home? Nearly unpacked now?

  • All the information you need to apply for your Statutory reports is here hun. They do each have a form you can fill in but I believe will still accept a letter as long as all the info stated on that page is included.

From what I understand the online Statutory reports don't always have all the information on them. The paper ones are far more complete and reliable. I've always got the paper ones myself so am just going by what I've seen posted on the forum.

You're most welcome. You've come such a long way from your first posts earlier this year and I'm over the moon you already feel settled in your new home. Don't chew over past decisions, just be confident that you made the right choices at the time for who you were and what you knew. Now you're making the right choices for who you are at this time and what you now know.:A We can only do our best at any given time.

Alistair gave you lots of really good info above too.;)

  • If it helps at all Maizy, none of my debts were for specific things - I listed them as clothes, living expense, travel expenses, general expenditure etc - my OR chatted about the length of time these debts were accrued over, and described them as 'for this and that' rather than specific items. Also, I had only a few statements for each debt, like 2 or 3, and no statements on my main account (as paperless) and he said that was absolutely fine, just send what I had.

    Take care

  • Maizy,

As a bankrupt, your affairs are supposed to be in a mess, it's what courts and official receivers expect.

I think the OR will expect you to present those affairs as completely as you can, which is what you are doing.

But there's no point trying to unearth statements and receipts from years ago.

Your explanation of your spending is true, believable, and fits nicely for what we could call a domestic bankruptcy.

You no longer have to live with the debts, but you will have to live with - and on - your bankruptcy budget.

Seems to me some people leave themselves needlessly short by not setting that appropriately.

It's not something I know about, but lots of people on here do know what's allowed and what isn't.

Getting that budget right is important for your future, so best to devote energy to it rather than to your debts, which are only relevant to your past.
