M&S refusing return of a sale item?

I bought a top in the M&S sale and they made me sign the receipt saying it is non returnable. It is not damaged or anything I wish to return it because it does not fit right (didnt have time to try it on)
I thought it was illegal to state 'no refunds' :confused:

    as far as i know they are under no obligation to take anything back unless theres something wrong with it so the fact it doesnt fit wont come under that, you should have tried it on in the shop

    M&S regularly stamp items at the end of their sale with either a P or S and there are usually big disclaimers saying that the items are non refundable. Unless it is faulty and this wasnt advised to you on purchase I dont think you have any comeback I'm afraid.

    It is only illegal to state no refunds if that statement is intended to deprive you of your statutory rights. That is why you will find at the bottom of the refund policies of reputable companies "Your statutory rights are not affected".

    You are not automatically entitled to a refund for something that doesn't fit. Many shops have a generous policy of allowing this but that is their choice and is in addition to your statutory rights.

    You would still have been able to return it if it was faulty (in accordance with what BargainJunky has put) regardless of what you signed.

    Agree with above posters. The reason M&S are doing this is they want rid of all the clearance stock hence that's why it's so cheap and that is why their usually generous returns policy has been stopped for these items only. It does say this on signs all over the store near me but if it is genuinely faulty (and this wasn't pointed out as explained by BargainJunky) then you can still get a refund with the receipt

  • I work for m&s and I can confirm that Items In the sale are stamped with a 'S' for sale. Items cannot be returned (unless faulty etc) as M&S want to get rid of all the sale Items which Is why they cost so little.

  • When the stuff at M&S gets to the end of the sale they make Management Reductions these items are the ones you can not return. So different stores will have different prices as these are special Management reductions set by that store the items are usually stamped with in S on the inside lable and the price ticket so that when other staff can tell it was a management reduction. You see the last reduction on the till may have been £12 and the manager reduced it to say £4 so the price need over-riding and somebody tries to return it without a recipt the store would give you a credit note for £12 this S stamp and not returnable on the recipt allows staff to know it was a managers reduction and the store not to loose any more money than it already have by reducing it so low.

    I had the same problem, bought some jeans in the sale Ok they were only £5 but they didnt fit !! No refund... might just sell them on ebay instead :)
