Expenditure form

Hi im not sure if this is the right place to post this but here goes anyway,

A few years ago i had a debt that was sold a few times and as i didnt keep up the agreed payments and in the end i was taken to court, the court knocked off £2000 in charges and i sent an income and expenditure form to them, The outcome was that i had to pay £25 per month and i pay that by direct debit without fail, Two years later the solicitor working for the other party has now asked for more money, i have told them this is out of the question and they want me to fill in another income and expenditure form, i have told them that nothing has changed but they insist.

So therefore my question is do i have to fill in this form yet again or not?

And if so can i charge them for my time and effort?

    Seems a reasonable request to update your details, many in your position simply wouldn't increase repayments even if they won the Lottery.
    Your agreement was reached 2yrs ago so it is not unrealistic to consider you may have found a job by now.
  • Hi thanks for your reply, I do have a job i always have had a job, i also have 4 kids and a mortgage to pay, im self employed and the recession has hit me like every one else, money is tight.

    I phoned them as they requested in a letter and was not impressed by thier manner, They spoke to me like i was scum, that got my back up and thats why im writing this.

    By law do i need to fill in the form and can i charge them as im doing a sevice that they require?

    I would rather not fill in the form now (not that i have anything to hide) but im not sure where i stand.......

  • most lenders in this situation would ask for an update EVERY 6 months,not after 2 years, and NO you cant bill them for your time

    An update after two years is more than reasonable. Some expect six monthly updates.

    If you fail to do ask they ask then they will be within their rights to revert you to full payments.

    Ask for billing them for your time don't be ridiculous.

    You could charge eleventy slevin pounds for your time and they don't need the form back until Julember.......that makes about as much sense as your question on expenses for your time.

  • Wow. They did you a favour by reducing your payments and now you want to charge them for it. Don't forget to kick them in the knackers while you're droppping the form off.
  • Hi thanks for all your comments ive calmed down a bit this morning and have decided to fill in the form,
    Just to clear something up i didnt want to charge the court for my time , i wanted to charge the solicitors acting for the debt company that now want me to up my payements, i thought that once the court ruled and told me to pay £25 per month, that i had to pay that until the debt was cleared......
