One more question, In the off-chance there was a case against me and she was claiming income support up until the rules changed where csa payments no longer have any bearing on income support. Would the csa come after me for money due after the date in which the rules changed ? This is assuming that she would tell them I have been paying her.

The CSA would need paying from the start of the case, as some of the money would be due to the Secretary of State too. If there is a case you would both need to confirm the payments made since the start so they could be taken off the total that you owe.

Ok so I would owe money to the gov because she was on income support but would I still owe money for the time after the rules changed or after she came off income support?

It's all getting a little hypothetical, but if she had opened a case (for income support reasons), and had never closed the case, then you would owe a certain amount of child maintenance, part of that would be due to the Secretary of State, and part of it would be due to the PWC (less any amounts you had paid her directly since the case began).

I guess the first, and most important, step is to find out whether there is a case against you or not. You can call the main child support agency number and they will be able to check that for you.

I know this is an old thread, I did eventually contact the csa and gave them my NI number. They said that there was nothing in the system about me what so ever which was great!.

One thing Im concerned about is, could there be a case in her name against me and they just dont have my NI number associated with that case so it looks like there is no case against me? As my ex would not have known my NI number. And if that was the infact the case would I only be expected to pay from when they eventually did associate the case to my ni number and contact me.

It is very easy to trace a NI number to an address for the CSA they do it 1000's of times weekly...

You will not have to worry if they say you are not in there system...

You give a name, date of birth and address and NI number, you can be traced albeit somewhat harder by an individual of these at any time...

Some PWC manage to get claims going with just a name and no address so don't worry so much...!
