Resignation and holidays

I am just wondering that I have 2 weeks holiday in October at the end 17 to the 28th but I wish to resign from my present job. The holiday was agreed before I was TUPED over another company. Will the new company honour this and can I resign and have the holiday or do I need to give them a full 4 weeks working notice.:(

    I think what the OP is asking is will the company honour the holiday if the OP resigns now, or will they insist they work the full 4 week notice and therefore refuse permission for the holiday.

    OP, your employer (TUPE is irrelevant here, this goes for any employer) does not have to honour your holiday - but they have to give you notice if that's the case. So if your holiday is two weeks long, they need to let you know two weeks before that (the same length as the holiday itself) that they intend to cancel your leave.

    So yes, it's possible that if you resign, they will cancel your leave. It's also possible they will let you go on 16th and take the holiday. You may need to negotiate, though. For eg, they might suggest you do the two weeks' work, take the two weeks' holidays, then do another 2 weeks at work before you leave, so that they can get a full handover.

    It really depends on your job, the importance of your job, how much sway you hold with them, and what they need you to do before you leave. But to answer your question bluntly: yes, they can cancel your leave.

    I thought that it was double the amount of time. So if you were taking a days holiday they would have to give 2 days notice. If you were taking two weeks holiday then they would need to give 4 weeks notice....

    When I resigned from my last company I had a holiday to the states booked for the last 2 weeks of my notice period. I had no intention of doing it at that time it just happened that way. My company were fine with it and I worked for the devil wears prada!!
