How to stop CMC's

Not sure if this is the right place for this.

CMC's are getting out of control. I get called at least twice a week from them to get back the 'thousands of pounds that are owed to me' yet I have never had PPI. That on top of the horror stories on here around the fee's, extra complaints being lodged without even knowing, and the lies told by CMC's.

Whos responsibility is it to stop them?

    I like the way that Tucan claims phoned an MP and told him they represent the Govt and can all sorts of money repaid.

    He called them a scam. Unfortunately, when we use that sort of language here, there are some claims companies that complain to the board admin and get the posts edited/removed.

    The Claims Guys made false claims to me that I, as an IFA can put in a complaint about insurances that I put in place for myself. I think John Mann MP's story trumps mine but it does indicate the level of lies these companies give out just to get money out of people.

    The ministry of justice regulates these companies far too lightly.

    It would be nice but it is being run by a trade journal for mortgage brokers. IFA's would also directly benefit but indirectly it is likely to help the population generally because it will help to highlight what the ambulance chasers are up to.
  • Hi There, I hope this is the right place to ask this question. My mother, who is 75, was cold called a couple of weeks ago by Tucan claims. She didnt even understand what PPI was. She has a M&S credit card that she rarely uses and if she does, she pays the balance before she pays interest. They said they would send her a pack. A few days after the call she told me about it. I advised her that if she had indeed being paying PPI we can claim it back without the intervention of a CMC. When I next visited her my Mother showed me the pack she was sent. They stated that she could reclaim £1800 and that for them to proceed she must pay an " upfront charge " of £249.99! I was quite cross and told my Mum to put the whole thing in the bin. Yesterday my Mum received her credit card statement from M&S and as you can guess, they have (Tucan claims) charged her card £249.99. When i asked if she had given them her card details she states that she can't remember, and that they must have had her details to know about the card. I explained that she was probably randomly selected and they just "struck lucky" when they called her. My mother is obviously very upset at being duped in this way and i have not admonished her for being foolish and giving them her card details, as she is fully aware of this herself. I have spent all day on the net reading various Forums that mention Tucan claims. It has been over 14 days (23/9) since they called her and took the money. She wasn't aware until she got yesterdays statement that money had been charged, so is out of time to cancel. I now come to my question. Can she claim the money be refunded by M&S under Section 75? My Mum has spoken to Tucan claims and have told her to "write them a letter cancelling the agreement". She was passed from person to person who tried to fob her off and kept saying they will get money repaid via her claim. She hasn't paid ANY PPI! I havn't come across any postings where this fee has been repaid.
    I am going to be complaining to the Claims Management Regulation Monitoring and Compliance Unit at the Ministry of Justice, but I fear she has seen the last of her £249.99. As I have read through the many postings regarding Tucan Claims it strikes me that the majority of people being scammed by this company are vulnerable pensioners and something has to be done to stop them.
    I am sorry this post is so long but I needed to explain the situation fully.
    I hope there is someone on here that can advise me how to get my Mums money back.

  • The Ministry of Justice has published a warning on the taking of upfront fees (to ambulance chasers, not consumers) which demonstrates that this breaches it Conduct of Authorised Persons rules.

    So yes, you should complain about this behaviour to the MOJ.

    However, because the MOJ has made quite clear that they cannot make the charge before the pre contract information it seems to follow that they cannot lawfully have obtained the consent of your mother to debit the account.

    That would mean it was an unauthorised debit and your mother could ask the card provider to reverse it.

    I suggest both actions are done.

  • Vultures is an apt description! Mum says they are calling her about 5 times a day! She has called M&S today about claiming the money back via section 75 and all the woman said was " we dont deal with that, call Consumer Direct". This is after she called them on Monday and was told to lie about the date she was called by Tucan claims so she would be within the 14 days cooling off period! She was appalled at this advice. They aren't really that much better than Tucan claims. I am now going to have to find out how she claims it back through M&S. Does anyone have any advice?

    I was also cold-called by Tucan Claims back in 2009. At the time I was in a vulnerable state and I stupidly gave my credit card details to them in the hope of getting back some very much needed extra funds. Stupid of me I know, but at the time they seemed genuine. After 2 YEARS of constantly badgering Tucan Claims for a refund of my initial payment of £249.99, they still continued to inform me that I would be entitled to some money back and I had to be patient. Even though they promised me some money back within 6 weeks of my claim. JUST DON'T GIVE THEM YOUR CREDIT CARD DETAILS IT IS A TOTAL SCAM. After 2 years of calling them, writing letters, emails etc I got absolutely no-where with them. I followed all their procedures in their terms and conditions regarding putting in a complaint with them but to no avail. Eventually in January of this year I was told I did not have a claim in the first place (i.e I did not have PPI on my credit card, which I told them in the 1st place that I didnt, because my initial claim was about my credit card company putting up my limits all the time. Then Tucan change their minds in their claims procedure just to confuse you and keep your money longer). After going down every avenue with the Company I was at my wits end because I really needed my initial payment back. After weekly calls to Tucan from this January 2011 they kept on telling me that they have no way of contacting their Finance Department to chase up where my refund was. After many months of chasing them I finally got a lead from someone on a forum that to try and get in contact with the Claims Regulation people in Burton-on-Trent, Derbyshire. After an email to them I was immediately contacted by them and 2 weeks later I received a cheque for the full amount from Tucan Claims. A result after over two and half years of fighting with this Company. PLEASE PLEASE PLEASE EVERYONE OUT THERE DO NOT GIVE YOUR DETAILS TO THIS COMPANY IT IS A TOTAL SCAM AND THEY PROMISE YOU THAT YOU WILL GET THOUSANDS OF POUNDS BACK BUT YOU DONT, ALL YOU GET IS A VERY LARGE PHONE BILL AND ALOT OF HEARTACHE. Hope this helps everyone out there and if you would like the email address of the Claims Regulations team just post me a reply to this and I will send it to you.

    I have now had two calls from Tucan in the last week. I played along with the second one by giving negative responses. I was told by them that the UK Government had ruled that lenders couldnt increase credit limits and I could get £3300 back. I was also told I could get my insurance back, despite never having any.

    I have reported them to the MoJ as the lies are disgraceful. When an MP comes out and calls a company a scam company then you need to take note.
