help please regarding baliff visit for previous tennant

Had a letter this morning for previous tenant stating balance needs to be settled in full or they will attend property and remove goods. The letter also states that they have powers of entry are able to use locksmiths and enter my home in my absence. This is not my debt what should i do and can they really enter my home when in not in ?

    How about not reading someone else's mail?
    I used to be indecisive but now I am not sure.
  • the letter says my surname on it as the previous tenant had same so just saw that and opened it

    Suggest that you write or call them and arrange a meeting at a time to suit you and prove to them that you are now the tennant of the property using your tennancy agreement or such like, a passport or other official document with a photo would help prove who you are.
  • Call them and tell them you're not the tenant.

    They'll probably ask for some proof such as a tenancy agreement and a passport. You're not technically required to show them anything, but to get them off your back I probably would.

  • It is not for you to prove you are not the person they are after, it is for them to prove that they have found the correct person.

    For the sake of keeping things simple I would advise co-operating, at least as far as showing them a letter in your full name to show that you're not the person they're after.

    Then with that done tell them to go away. They're trespassing on your property if they remain after you have told them to leave, they have no rights to be on your land, enter your house and certainly not to interfere with any of your property because you are not their debtor. If you discuss this with them, then tell them that (as opposed to asking 'I thought it was true that...') and tell them that you've spoken to a certificated bailiff about this.

    If they still refuse to believe you or refuse to leave (they may think that because of the same surname that you know their 'target' and know where they've gone), call the police and tell them you have people on your property making threats to you about someone else's debt.

    Someone is threatening bailiffs and breaking in to OP's home. OP needs to know about this. I would advise OP to read all wrongly addressed incoming mail from now on.

    That's a massive coincidence. It feels as though there is something you're withholding from your opening post.
    Nevertheless, bailiffs are not allowed to enter your property unless they've successfully previously entered. Make sure windows are closed.
