    You are very welcome, dont let it grind you down. There have been times when I have nearly slipped back off the edge but thanks to many lovely MSE'rs I have got this far (there have been a few unwarranted nasty comments but mostly i ignore them now, however where debt and mental health are concerned I refuse now to be stigmatised for something I had very little control over at the time and I have found that for me at least speaking about it helps lessen that stigma, but thats not easy for everyone, I know). Just remember you are not alone and you can get through this difficult period of your life, it may not be easy but when all is said and done its a debt, it can always be repaid,but your life and health is something much more valuable.

    UNFAIR OR IMPROPER BUSINESS PRACTICES

    Communication

    3.1 It is unfair to communicate, in whatever form, with consumers, in an unclear, inaccurate or misleading manner.

    3.2 Examples of unfair practices are as follows:

    j. contacting debtors at unreasonable times

    k. ignoring or disregarding debtors' legitimate wishes in respect of when, where and how to contact them, for example, shift workers who ask not to be telephoned during certain times of the day, or some debtors may request contact by letter rather than by telephone

    and for an update, the daily mirror are very interested in getting my whole Payday Loan experience out there. I will keep you informed how I get on.

    Got a nice letter from them this morning refusing to stop contacting me at work or by any telephone number and they even quoted the sections they were guilty under and said they were irrelevant, when they clearly are not.

    I asked them to send me a signed exectuted copy of the credit agreement, of which they sent only a copy of the application without any evidence of agreement.

    Arrgggh what a bunch of idiots, I already told them I will not enter into dialogue off their telephone calls so surely when they continue to do so it can only mean because they intend to harass?

  • Thanks Tixy, that is exactly what I have decided to do. However I find it frustrating that you have to wait 8 weeks to lodge a complaint with the ombudsman.

    With the ombudsman you have to wait 8weeks from your formal complaint unless the creditor has given you their final response sooner than that, if they have you can go ahead with a complaint to the ombudman.
    No 8week wait to complain about a breach of the DPA to the information commissioner though, or to the OFT for unfair debt collection methods.

    They have given their final response and they said they still had to wait 8 weeks?
