Arrears! Who gets paid first, the state or PWC

Does anyone know or had experience of when CSA arrears are owed to PWC and to state, if NRP starts to pay them off who would recieve their money first.

  • Phone the Csa and request you get the arrears 1st thats what i had to do otherwise they will go to the States debt first.

The PWC should get the payments first, then when the arrears owed to them are cleared the payments should start going to SoS.

However, I didn't get my payment one month and when I queried it I was told it had been paid to the SoS in error. It took months to sort out and the CSA tried to fob me off time and time again until the ICE were involved. Eventually I got my payment and £25 payment from the CSA for their error causing a 14 month delay!

If you are in this situation, don't let the CSA try to tell you otherwise. Legally the PWC should be paid first!

Thank you for that. If they ever sort it out Il make sure I do. Although Im not in much hope that I will ever recieve a payment, Ive never recieved a penny. I go through phases of phoning them in the hope its getting somewhere but it never is.

Sounds like my case was for years. It wasn't until I really got fed up with being given the runaround and getting nowhere and also had time to spend chasing the CSA that anything happened.

Don't give up. I really thought I was wasting my time but at last, 13 years after starting the CSA case, I am getting reasonable monthly payments and had an advance payment for arrears dating back years.

    Good luck.:)
  • Usually when a payment comes in it will be allocated to regular maintenance first, then PWC arrears, and finally SoS arrears.

Thats good to know. As far as I'm aware he only owes arrears because I have been recieving nil letters. Although the amount has increase £5,000.00 from the last liability order to the one the CSA informed me last that they are trying to get now.
