Advise Urgently Needed, Please

Please can you help or advise me on a problem.

In 2001 my husband got us in to financial difficulty. I called the Debt Advise line and was then referred to FCL, then Payplan, with whom we have an arrangement with our creditors through.

Because my husband had taken out a secured loan amongst his credit cards the secured loan had to be a priority payment so we had to pay them their full amount each month. Because of this a personal loan we had taken out before the problems started could only be paid £37 per month instead of £243. This company also filed a CCJ against us and put an Interim Charge on the Land Registry Files. We went to court to fight this, I took all my documents and files and the Judge went

In our favor and refused to finalize the Charging Order.

In 2004 we decided to re-mortgage. This was held up for 7 months because of the Company who we had, had the problems with had not had the Interim charge removed. I had to investigate all this and then I wrote to the Judge at the County Court, reminded him of our case and asked his advice. They had been wrong not to have had the charge removed and he advised me to contact land Registry as he would, and it would eventually be removed. There was then another 28 days to wait before it was removed.

In June 2006 I sent for a statement as I had had no correspondence from them for 4 years. It turned out that they have been charging "Late Payment Fees" every month for 4 years, to which I had no knowledge of. We have had no correspondence whatsoever to notify us of these charges or in fact that we were making late payments. From the 20 December 2001 to 20 June 2006 we have been charged a total of £4144.26 in Charges. I have written to them 5 or 6 times since regarding this. To date I have had no reply and they may well be still adding to these charges and probably are.

I do not think this is right. But would like your help or advice in this matter if at all possible. I have not mentioned the name of the Building Society concerned, but have no problem doing so if you find it might help my query/problem.

    I would ask them sweetly for a copy of the letters they sent you regarding these charges, and the proofs of postage. I would also approach the debt management people, as this should have been their job to sort out and stop and fees and charges being added.

    Hope you get it soted out. Don;t let them scare you into paying it.
    This year I'm getting organised once and for all, and going to buy a house with my wonderful other half. And that' s final!
