how do you remove missing person from a mortgage and Deeds

I bought a property with my then partner back in 1989. In 1992, I parted from my partner, and at her wishes tried to transfer the deeds and mortgage into my sole name unfortunately at the time I was unable to meet the criteria set by National Westminster home loans. In the February of 1994 my partner contacted National Westminster home loans again in an attempt to transfer the property I also attempted to have the transfer sanctioned in January of 1995 and again in April 1995 but again due to circumstances I was not in a position to accomplish the transfer, and after that I lost all contact with my ex. :(

In 2002 my wife and I then decided to market the property with a view to selling, unfortunately even though we found a buyer the sale fell through as nobody could contact or find the whereabouts of my Ex, our Solicitors at the time contacted National Westminster home loans and a litigation solicitor but no trace was ever found.
For the past nine years, we have tried to locate my ex with every means at our disposal with no luck.
Would anyone be able to point us in another direction we might be able to pursue the removal of my Ex from the deeds at least, and the mortgage.

  • Not sure i could give you any advice as such - but you have my sympathy...my ex partner, who i haven't seen for 12 years is also on the mortgage & deeds to my house...which i am going to sell shortly...i'm pinning my hopes on the fact that i know where his parents still live and hoping the solicitor can track him down through them..fingers crossed...

    AFAIK only a court order can have someone removed from ownership of the property, but that is related to matrimonial issues, rather than this scenario. If you can do that, repaying the mortgage on sale is enough to see the missing borrower's interest end.
