I am wondering if someone can help me as I am really worried.
I have a loan with Alianze and Leictser which i have been paying back by way of a direct debit for the last few years. I recently receieved a debt collection letter to say that my account has been passed to a debt collection agency as they have not recieve the dd since oct last year!!!!!! baring in mind this was the only letter i recieved. I rang them up and they said that i have cancelled my direct debit but i hadnt so they said call your bank. I called the bank and they confirmed that i did NOt CANCEL my direct debit and it is the case that alliance and leicster have not been taking the payment. I now have almost 2k penalty charges. where do i stand? what rights do i have? when this is sorted, should my monthly re payments increase? i dont think it should as it isnt my fault they just stopped taking the payments.... please help

sorry, but are you saying that the payments haven't been coming out of your account for nearly a year but you haven't noticed it?
If this is the case, then surely you should find it easy to clear the balance as you should have loads of extra money in your account.
As far as the charges are concerned, ask Santander (who run Aliance and Leicester) to waive the charges as, if what your bank say are correct, they haven't been taking the payments. if you can get it in writing from your bank and send it to Santander then all the better.We've spent decades teaching people about their rights, but nothing about their responsibilities.0 -
Did you not notice the payments hadn't gone?
Is the money still in your account or have you spent it?
Ask your bank to put it in writing that A&L haven't clasimed the DD. Get the bank to send it to you not A&L. Photocopy it & send it recoreded delivery to A&L asking them to remove the charges.Try to be a rainbow in someone's cloud.0 -

You need to file a written complaint with alliance and leicester preferably including any proof from your bank that you didn't cancel the direct debit.
Hopefully they will fully investigate and sort your complaint. If not you canthen go to the financial ombudsman but you must first have exhausted the banks (A & L's) complaints procedure which can take some time so you need to get the complaint in as soon as possible.

The answer is no I dont have loads of left over money in my account.I dont check every month to ensure that direct debits have come out, this is why it is called a direct debit. I would also expect the company to tell me if a direct debit has not been coming out for whatever reason and not leave it a year.
This isnt a board that is open to allow people to vent thier sarcasm it is to give constructive advice......

In general, people with lowish incomes are going to notice the payments stopping and just think it's a bonus......the money then gets wasted elsewhere and then it's up to the borrower to act all suprised and come on here moaning
