My departed Wifes Loan & CC

Hi everyone I would just like some advice about my late departed wife’s loan and cc I informed the bank of her death but they still charged me all the interest on what she still had to pay back on both of them but I was informed that both accounts would be frozen at the time of notification of her death but they have charged me with everything are they allowed to do this or will I be able to reclaim anything back.

Any advice would be much appreciated.

D Wilson.

I am sorry to hear of your loss.

Are you sure they have charged interest after her death or merely applied the accrued interest up to the date of her death. They shouldn't be charging interest after the date of her death, but they are allowed to apply any interest due up to and including the day before.
  • I echo Bossyboots's sentiments.

I suggest you ring/visit the bank to clarify this. If you're still unsure, go to your local Citizens' Advice Bureau for help.

  • If your wife died and left no estate and if the loan abnd CC were in her name only... they cannot chase you for any debt, and as such it would not matter when and if they stopped the interest as you have no obligation to pay them and they cannot collect from your wfe obviously...

I had the same problem last year when I sorted things out when my Dad died... He had no estate and no other person was laible.. no joint debts, so I sent copies of the death certificate and told them all to sod off...

Some wrote back and asked me to contact the insurance companies so payment protection would pay them off, but why should I...? The companies could do this themselves as far as I was concerned... and I knew they couldnt claim anything from me as I was not laible..

    However,

If there was an estate or any are joinlty owed, then you will need to make payments off, but it is not that simplistic, so if this is the case, then I would recommend seeing CAB or the Solicitor dealing with the estate...

I am so sorry to hear of your sad loss.
There is a really good thread that Martin has started over on the Marriages,Relationships & Families board called "What to do when a partner or spouse dies" not sure how to do a link for you but it might help you.
    Best wishes mandymoo
