Student Loans Company Error = Debt Collection Advice Needed.

I am BRAND NEW to these forums so I need simple, step - by - step instructions on how to deal with the SLC.
I have an original student loan taken out in 1996. I have never earned enough to start repaying it so have deferred it every year.
Without fail there has always been a discrepancy with deferring the loan; either the deferral forms haven't been sent or my documentation has gone missing.
In 2009 I sent all of the relevent documentation to defer the loan. SLC advised me I had only sent 1 payslip. I re-sent the documentation TWICE more. SLC advised they had received neither of these.
I advised SLC that there was obviously a problem with personal details going missing, and that in the current climate of identity theft I would not be sending anything else until they could allocate the documents already sent.
I heard nothing from the SLC until earlier this year when Buchanan, Clarke and Wells contacted me on the SLC's behalf, chasing the loan amount AND charges (I have NEVER been contacted by a collection agency in my life!).
I explained the situation to the advisor and have heard no more from them but a letter arrived from SLC yesterday telling me what my monthly payments will be and the arrears of over £2000.
As it is an original type loan it should have been cancelled in 2010 when I turned 40. Instead I need to unpick the SLC's mess and get this sorted.
Where do I start?!

you staret by producing the recorded/ special delivery receipts as evidence, and if you can't prove you sent and they recieved, you are stuffed.Debt free 4th April 2007.

my OH took out a student loan in 2004
he has never earnt enough to pay any back and is now on benifits due to ill health and having had a nervous breakdown in oct 2010
we have had a letter today of link financial asking to make contact to repay
he is 56 now and unlikely to be fit for work at his old job at least for the forseable future at least
what can we/he do

I've got "old scheme" deferred loans with the SLC, I've not worked (other than a temp part-time job) since I graduated.
I had problems a couple of years ago with my letters to the SLC going missing, so I sent copies recorded delivery. I NEVER got proof of delivery, and went through the Royal Mail for compensation.
So what can you do if you tried to prove you've written & the proof is not available because of another department's failure?
By the way, I think the stuff I sent was actually received because they did eventually reply. Which suggests to me that the postie just dumps the stuff on their doorstep & doesn't bother getting anyone to sign for it.0 -

If you didn't get proof of delivery you needed to send it again. The onus is on you to make sure the documents get there. Special delivery is the guaranteed product, or other mail carriers are available.
I am sorry but it was up to you to keep trying.

I have heard of SLC taking ppl to court, be careful, send the info recorded and KEEP a record of when the accepted etc.. At the end of the day, you/they borrowed the money and need to follow the agreement..0

i'm confused about the cut off at 40..... my understanding is that loans from that period were due until 25 years after graduation or when you hit 50 (or if you hit 60 if you started when you were 40). just checked the main site and that is what is on Martin's page too:

it sounds like there is a lot of misunderstanding here so i think it's best to get all the paperwork together and sort this out; the loans won't ever have been planned to be wiped out when you reached 40.
i honestly don't know what the best fix is here, but i would always encourage getting in touch with them asap. you may find more people on the student board who have dealt with this kind of situation. the most important thing i can say is that although the SLC have rubbish admin (that's a given in all threads about them; their organisation is often abysmal), that does not remove personal responsibility for ensuring they have everything that they need. it's never wise to just ignore it and hope it goes away...... student loans are a bit like the inland revenue/HMRC; they never forget........:happyhear0 -
