Mortgage company chasing money not owed

My mortgage due date is the 15th of each month and last month as my car tax and insurance was due at the same time I called the company and told them that it would be £50 short and I would go back to my normal payments plus a little more to cover in September.

The man said fine and wrote up the notes and put me back down as making normal payments as from September. I asked him to read the notes back to me as I know all conversations are taped.

Well the company has rang me 2 times on 31/08/11, 3 times 01/09/11, 3 times 04/09/11, 3 times 05/09/11, 3 times 07/09/11, 3 times 10/09/11, 3 times 12/09/11, 6 times 13/09/11, once 14/09/11, 3 times 15/09/11

I answered the call each time and explained that I have an agreed plan in place and to check the notes before accusing me of not giving notice of paying £50 less

Now today I received a letter today saying I owed £300 odd pounds plus late fees ect for a broken agreement plan, so I rang the number on the top of the letter and by this point I was steaming but I remained calm and explained what had happened. The staff member says everything I explained to him had been documented in the notes in August and he could see what has happened, the previous staff member had started the plan back up in August in error and not September as per the agreed notes. It just so happened that the person I was talking to was the manager and he agreed to remove all additional charges as I hadn't broken the agreement plan.

When he actually looked at my account he told he that I was paying £150 over so he was going to re-set my agreement at the correct level and if I wanted to continue to pay more that's fine.

He also said he is going to have a word with the last person that spoke to me as it was them that added the charges to my account as they hadn't read the notes on the system.

Now I am not happy about the x amount of phone calls I received. I am aware that it was an automated system that rang me but surely one person out of the twenty odd that spoke to me could have read the notes.

My question is should I raise this matter further about staff not reading the notes therefore causing me distress with the constant calls and basically calling me liar or should I just leave it as the matter has now been resolved?

  • Yes tend to agree with dannyboy on this one, priority number 1 should be the payment of the mortgage, after all you could take 6 months car tax and pay the insurance on a ddm. Your case is rather flimsy.

  • The really bad news is you have almost certainly ticked up a mortgage late payment on your credit report (and that is about as bad a one to choose as there is) so i suggest you check your report out - and possibly a series if it isn't 100% up to date in subsequent month. Other than that can't really add anything to the previous couple of posters.

    As per my mortgage agreement I never broke any rules I followed the steps exactly as explained to me.

    1. I am paying the mortgage early so I am paying the minimum amount I am allowed to overpay, so paying the £50 less was perfectly acceptable.

    2. As I previously said the staff didn't take the time to read the notes only the manager was able to resolve the matter.

    3. I do not owe any money I am in the red.

    My issue was with the constant calls I was getting and people not doing there job. The person that amended my agreed level of pay put it up to what I was actually paying and not leaving it to what was agreed. Anyway the manager has sorted that out now so I will just put it down to experience.

    It sounds like a case of the OP using incorrect terminology or inappropriate colloquialisms to the wrong person at the wrong time.

  • Next time, borrow the money you need for car tax/insurance from family/friends - your mortage should be your highest priority.
