Seller doesn't own item?

  • Still no communication or refund from seller so have now escalated the claim.
  • To be fair, someone who isn't a regular seller and isn't currently selling probably won't have planned to spend much time online. Not everyone checks their emails 17 times between 3pm and 9am!

It's right to escalate the claim though - that doesn't harm anyone. But don't assume the guy's a scam artist, there's an 85% chance he's just a normal bloke trying to get on with his day. He might be working shifts, caring for a newborn, on holiday, anything.

It's lovely to give people the benefit of the doubt and it's refreshing too.

'that doesn't harm anyone' is a little puzzling though in the world of eBay buyer's protection.

A sale is a contract for 'normal blokes as well as business sellers.

The OP's seller has taken hard-earned money and failed to provide the goods in a reasonable time is the point, surely?

(and the OP has been very patient with this seller, I feel)

I tend to agree, and I think the lack of any urgency in dealing with what is potentially a very serious matter rather suggests the seller really isn't too worried that his account really has been compromised.

If you're selling on eBay - and this goes back to our other conversation - then you should really be checking your listings and account fairly assiduously, it's not actually that much to ask. I have just listed a few items and I am checking them every so often.

It's the lack of commitment and respect to a paying customer that gets me as both buyer and seller. As seller this sort of thing makes eBay look bad and discourages people from buying. As a buyer...paying money to someone who then goes AWOL for ten days (as is happening to me right now) kind of makes the whole thing pointless.

  • Have recieved 2 emails of the seller one saying that he would refund me immediately and the other saying this........

I believe the amount has already been deducted from my paypal, as displayed within my account details. Therefore I currently have no option to refund. Can you confirm this please

But there is no refund showing on my Paypal account and if i click on the dispute case it says "awaiting seller response". So I have told him this and told him to check his emails as he should of had one from Paypal as to what to do next. Also I told him to contact Paypal if he is confused of how to refund me.

Surely it can't be that difficult to refund me?

when a claim is started the funds are removed from the sellers account and placed in a holding account by paypal, so it cannot be used. its no good telling the seller to look for emails tell him to look in the resolution center in his paypal account, this is where the dispute details are
  • Thanks texranger for the advice had no idea that Paypal "hold" the money (this is the first claim that i've done) guess i've just been lucky. Now passed the info onto the seller. So hopefully now i'll get my refund.
