Shoes don't match

I saw some gorgeous shoes on eBay described at new without a box. They were on an auction with ages remaining, so I emailed the seller and asked if she'd put it on buy it now. They were on auction for about what you'd pay brand new in the shop in question, as I get all my shoes from there, so I didn't think she'd get loads more for them anyway.
The photo of them was side on, so one shoe couldn't really be seen, but one shoe could.
She came back, and said she had done so - and added an extra £4 on as it the lowest the buy it now would take.
I went to back to say I was happy to pay the extra to put it on buy it now, but thought it was unfair to add £4 without asking me. We agreed on a price in the middle.
The arrived, and as soon as I opened them I was very disappointed. The shoes are supposed to be sparkly black, with 'patches' of silver sequins on them. Now I wouldn't expect these shoes to look exactly the same due to them having a random pattern, but they look completely different. One is black with patches of silver all over, the other is almost completely black, with about two silver sequins on it.
Anyway, I messaged the seller to tell her of the difference, and she got rude straight away saying she completely disagreed. We went back and forth and I realised I wasn't going to get anywhere so opened a dispute. I left it overnight for her to respond to, but this morning I find she has taken it to a claim with a big rant about how I'm trying it on, and tried to pay her off eBay, and all sorts of rubbish.
The annoying thing is I want to upload a photo to paypal, but it won't seem to let me. It says it's waiting for the seller to respond - but she has! She opened it.

It's hard to get a great photo, but on the left there are silver bits all over, and on the right a couple near the edge, and two near the toe. That's it."There is no medicine like hope, no incentive so great, and no tonic so powerful as expectation of something better tomorrow." - Orison Swett Marden0 -
They do look very different, are they black sequins on the shoe on the right? My daughter had some sequin shoes from next and you could 'brush' the sequins in a different direction to make them look more like the shoe on the left.0

They are sequins, but slightly smaller than the silver, and stuck down, you can't brush them."There is no medicine like hope, no incentive so great, and no tonic so powerful as expectation of something better tomorrow." - Orison Swett Marden0

I would just remain calm in your replies. Is it a not as described dispute? If so eBay will want you to return the shoes by a trackable method and you should get a refund.0
-
Yes, it is. I am unable to reply to the dispute at the moment. Wouldn't say anything bad like she has, but would really like to give a response, as she's going on about how I've just changed my mind and that I'm trying it on.
It's not true at all - I would have loved the shoes if they were a pair. I love anything sparkly and find it hard to get shoes that fit due to a condition I have, so am very sad to have to reject them."There is no medicine like hope, no incentive so great, and no tonic so powerful as expectation of something better tomorrow." - Orison Swett Marden0 -

Remember it's eBay you're really talking to in a case, not the seller.
Point out in your reply in the case that the picture in the listing did not show the shoes side by side, but side on, obscuring one shoe to (deliberately) hide the fact that the shoes are not similar enough in finish to be considered a pair in your opinion and friends and family too.
And the fact that they were sold as a pair but are very different was not mentioned in the listing means they were not as described.
On buy it now transactions you are entitled to a full refund for any reason although I presume you opened a Not As Described case?
You must send tracked to prove delivery to get your refund.
Just ignore her ranting. Your transaction was on eBay with PayPal I assume and she cannot get out of that.
You've every right to receive a refund, it's what eBay protection is for and she's a terrible seller trying to flog the shoes in this manner.0 -
I always think that when a seller (or a buyer in other cases) is so aggressive and comes out fighting like this then they feel guilty- which means they know they are doing something dodgy. The more they rant the nicer and sweeter you should be.
Just calmly claim SNAD as shoes are not a pair, and leave it at that.I’m a Forum Ambassador and I support the Forum Team on the eBay, Auctions, Car Boot & Jumble Sales, Boost Your Income, Praise, Vents & Warnings, Overseas Holidays & Travel Planning , UK Holidays, Days Out & Entertainments boards. ha ha! Well said and quite right!0 -
Paypal decided in my favour already! That was quick.
Annoying I now have to spend god knows what sending it tracked, but will do so!"There is no medicine like hope, no incentive so great, and no tonic so powerful as expectation of something better tomorrow." - Orison Swett Marden0
