Anyone know about Employment Law

Hi,
Can anyone give some clarity here

My partner recently started a new job and they have said that there is no contract and they just go by Employment Law.

They have said 28 days hols which seems to be inline with eployment law for all full time employees.

It seems as if there no overtime rate and you take time off.

They have also said 40hrs a week and you work a long shift (13hrs) one day on the weekend then get the next weekend off. so basically your off every other weekend.

However my partner has got rota and is down for 3 weekends in a row and over 40hrs. What can be done about this if nothing was in writing ?

    There is a contract - it just isn't in writing (or the main particulars aren't!). They should be - the law says so - and it should be provided within 12 weeks. And it isn't likley that the shifts would be outlined in the document anyway. Bottom line is - he just started and has at least 12 months before he can claim unfair dismissal (I say at least because the law will be changing to 2 years at some point). So he can be sacked for almost any reason they like. Sorry, but the best advice is stick his head down and if he doesn't like it find another job.

    The Employment Rights Act 1996 requires employers to provide most employees with a written statement of the main terms not later than two calendar months of starting work....has this been subsequently amended?

    I thought it was two months, too; I'm certainly not aware of it being amended.

    Argyll - Arduaine to be exact. Not worried about giving away my whereabouts, as I will regrettably only be here a day more. Arrived shortly before the hurricane did! But I think I have single-handedly refloated the Scottish economy whilst here!

    I doubt if there's anything that could be done about the shifts or hours anyway as I imagine the employer would be able to average them out over a longer period than a month. I'm sure SarEl will know for sure once the whisky wears off :beer:
