Sacked - when should I get my wages?

My 'contract' was terminated 3 months into a 6 month probationary period. Normal wages are paid on the 28th of the month - does my ex employer have to pay me before 28th Sept? I've not had written confirmation of the situation, nor my P45.
Please forgive me if my comments seem abrupt or my questions have obvious answers, I have a mental health condition which affects my ability to see things as others might.

so there is no legal 'right' to be paid within a certain time period? It's a small company - no HR or payroll dept, the boss gives the figures to a accountant every month.

  • I dont know about the legal time period, but I would imagine they will pay you on the usual date.
    Ring the boss and ask.
If they dont pay you then I suggest you go to the CAB and ask about how to get the money like through the small claims court.

No. You are only entitled to be paid on the next normal payroll date.

Hi mate, first of all I know how you feel. The unfair dismissal tribunal is 1 year service, and my ex-employer sacked me 4 days before this.

Secondly when I got my last wages they paid it on the 15th of the month, the usual day they paid. Also don't forget to check they pay you any holiday pay you have accrued in that 3 months. You are entitled to be paid that + 1 weeks notice in leiu.

Also guys, I think he is asking whether they can withhold payment until a later date, he is not wanting to be paid early.

You are also entitled to written reasons for your dismissal, by the way.

Clearl.y you need to wait until 28th and then if you are not paid what you are owed (including any holiday pay due) you should write them a polite letter first, and then if nothing within a week or so give them an ultimatum and you can take out a Tribunal claim for unlawful deductions, which will probably then have the desired effect of making them pay up.

Well the written reasons is true. However, I think you are only entitled to written reasons for dismissal after 1 years service.

I had written reasons but it was so vauge and didn't explain anything. I think they were just using it as a cover up... Seems suspicous I was dismissed not even 24 hours after joining a union

And most employers take advantage of this fact I think. I was dismissed on 29th july my years service was 8th august. My weeks notice took me to the 6th. So I was 2 days away from unfair dismissal
