payday loans question

Ok, before you all start I know!

But, needs must, and I had one of these with wonga, and then used someone elses credit card (with their permission to pay it off)
I then took another loan 6 months later, and wonga took the money from this account instead of mine. The other person had also cancelled their credit card with the bank (not for this reason) and the payment still went through.

Is this legal?
Who is to blame - wonga or the bank for allowing payment to go through after the account had been closed?

    Did you change your payment details when you applied for the 2nd loan? If not, then the fault would be yours.

    Did they first try to take the money from your account and were unsuccessful or did they only try to take money from friend's card?

    As soon as you pay off a payday loan with a card, that card is registered as a back up if the main repayment card fails.

    Basically they have done what you have agreed to, by using the card in the first place.

    You should now just be focusing on paying your friend back ASAP and looking never to use payday loan companies again.
  • Thank you for your post, they took some off me and the rest off the other card, so I guess that is why. Was my own fault as I could have extended it but realised too late. Thanks for all your helpful answers and the odd sarcastic ones too!

    Payday loan companies know every trick in the book, including the all too convenient I have lost/had my card stolen scenerio.

    The only real way to temporarily avoid any payment is to completely switch bank accounts, but then it is always better to try to sort it out with them ASAP rather than trying to avoid them.

    Avoiding them however, often brings huge charges and months/years of misery just for the sake of a few hundered quid.

    You really are just best to put it down to experience and try everything and anything to avoid getting out another loan, if you can't afford to pay back.

    EDIT....Deferring it is also most definately not a good option at all.

    So, what you really mean is....

    1) You took out a PayDay loan which you then you couldn't pay back when it was due

    2) You got a friend to pay it off for you, with their card.

    3) Having not learned your lesson from your previous experience you took out another loan that you couldn't repay

    4) The friend's card, now linked to your account, was used to pay off the loan automatically when you didn't

    5) Friend is now not happy.

    Guess what.

    You owe your friend some money.

    That was well put, and I totally accept that it was my own fault, I did say that. i have no issues paying it back to my friend and in fact no issues paying the loan back, just forgot to extend it when I should have. My only question was if they could take the money off someone elses card. I an see they can take it off my secondary card, but still don't see how they can take it off a card in a completely different name. But again, thanks for everyone's help.
