where has my tracker element of my halifax mortgage gone?

Hi, i wonder if anyone can help me please,
i took out a morgage in 2002 through the estate agent i bought my home from and they advised me on a halifax tracker/variable rate so i took it on and has worked well .....
until yesterday when i recieved a letter (dated 31/8/11) stating that the now type of product i have is the standard variable rate 3.500% and no mention of the element of tracker!!
it has increased by £25 i realize this may not be alot to some but thats not the point here
i contacted the halifax this morning and after the womon went of saying she needed to speak to her manager 10 minuites later came back to the phone saying i will need to contact the estate agent who "sold me the mortgage" there is nothing they can do,
has anyone else had this issue?
also (sorry to keep on) would it be an idea to switch or does anyone know the best thing for me to do? as my mortgage is quite a small one
i now owe on my mortgage £28k, many thanks in advance

    Do you still have your Key Facts Illustration (KFI) document and/or your mortgage offer? These are the relevant documents which set out the terms of your mortgage, including how long the tracker element was in existence for.

    I wouldn't be happy being fobbed off by Halifax if the KFI shows lifetime tracker. Halifax should be bound to honour those terms, irrespective of the intermediary through whom you booked the mortgage.

    I'm not sure KFI existed in 2002. But the mortgage offer letter would have contained product details back then.

    I genuinely don't recall Halifax ever offering a lifetime tracker deal. That's not to say that they didn't do at any point though. I can recall 25 year fixed rate mortgages, but I don't actually recall a tracker with a term longer than 5 years.

    Which actually makes this case look strange. The change advised to the OP comes at 9 years

    Possibly.

    More likely there's already been a product transfer on it at least once and this is the end of the second or third product that's sat on the mortgage account.

    Haifax should be able to tell which products have sat on the account, what conditions they had and when they expired.

    :APhone the servicing dept and ask them to check the mortgage code history held against the mortgage. They should be able to check the history to the beginning of the mortgage and find out what the term was. They can also organise a history sheet to be sent out however it may take a couple of weeks for all the information to be collated. I take it the mortgage was taken out with an intermediary in which case some details may not be held however the servicing team should still be able to organise these basics which should give you some answers. If you still feel you have be mis sold you would need to take that up with the intermediary as Halifax would only have acted on their instruction.
