Online Registar of Insolvency

Hi,
Just checked the Scottish Register for Insolvency online and they have BR's from years back on there! Isn't the Scottish one like the English registar in that the notice should be gone three months after discharge?

    How long is information available on the register of insolvencies?

    Information is available from the register of insolvencies for the year following the end of the action.
    Depends when you define the end of the action I suppose?

    Discharge in bankruptcy? End of a trust deed? etc.....

    The English IIR has entries going back a long way for BR cases where for some reason or another, discharge etc was suspended.

  • I can only speak from experience, as I have friends whose BR was discharged a long time ago with no complications and it's still showing on there so who knows.

    I've noticed that there have been a lot of changes to the register over the past few months so maybe it's not as up to date as their FAQs would suggest

    I would imagine it would be at least 5 or 6 years due to the statute of limitations. When I worked for a debt collection company we'd be chasing a debt from 3 years ago and the business owner would come back and say no I was made bankrupt 2 years ago, and we'd look at the register (for England or Scotland as appropriate) to confirm. If the records disappeared within months of the bankruptcy discharge then we wouldn't be able to check the information online.

    Nothing to do with the Limitation Acts at all.

    And the entries on the English register most certainly DO come off 3 months after discharge.

    You are most likely thinking of the entries in the London and Edinburgh Gazettes, as they are recorded online permanently.

    The Scottish RoI shows all 'live' bankruptcy cases, plus those that were discharged in the past two years.

    A 'live' case is one where the Trustee is still in office (maybe dealing with an asset). Once the Trustee is discharged, the case will stay on the RoI for two years after the date of the Trustee's discharge.

    The date that the bankrupt person was discharged will be shown in the record of the case.

    It is, isn't it? Must admit, I've never looked at the FAQ bit before...:o

    Maybe it's the User's Guide that's out of date - it still talks about paying to search the Register...

    But, I'm pretty sure that "the end of the action" means "when the Trustee is discharged".
