Change to my attachment order?

hi, i have a attachment to my wages which was always £5 a week ( i only earn £130-140 a week now as all i can find is part time work ) yet last week i have recieved a letter saying ANOTHER order has been made and i now have to pay £15 a week.

Previous after paying my bills that are nothing exsessive just rent and heating etc im left with £28 a week for food, clothes but now thanks to the new order i have £18 a week....anyone know how i can go about getting it re looked at? i caled the court on friday and the women on the phone was zero help saying if it was ordered i had to pay it

Its now at the point i sat down and worked out if i quit my job and signed on jobseekers i would have £44 a week to live on. Any help on who/where/what i need to do to appeal the new order amount?

  • Hi - a couple of suggestions:
    1) look on the HMCS courts website and see if you can search for the form you need.
    2) try National Debtline
    3) I can't believe that the court person was so useless -if you NEED to appeal the attachment then they should be able to tell you which form you need. Grrr:mad:

    What are the attachments of earnings for?

    Council tax?

    Or a normal CCJ?

  • A bit more info for you:
    The court should allow you enough money to live on. They may not allow money in your budget to repay other debts. Your employer will only be (or should only be) deducting what they are told to by the courts. The courts should allow you reasonable exepenses so either your expenses are higher than the figures allowed - in which case you need to get in touch and explain that your x,y,z bill is high because of ... or somethings gone wrong somewhere.

    Thanks for thr replys! i called and asked and they sent me a email with the link for the form i needed, i explained my rent and travel had incresed since last year when i filled in the forms ( think i was too honest ) and she said i had to fill the form in then pay £30 to have them look at it.....:( so not really sure what to do as even tho £30 wont sound alot to most people thats a weeks food money. Im going to ring back and ask if there is any way around it and if not i guess i will have to save for a few weeks

    Is it me or do they charge you more if you are in debt at the courts? urgh

    Have you checked that you are getting all the benefits to which you might be entitled? www.turn2us.org.uk

    Also have you asked the court whether you get any help with the fees given your low income?

    Often agencies are banned from advising people about their rights but are allowed to answer questions. If you do not ask, they are not allowed to volunteer the information

    Hi,

    thanks for the link and yes i get a discount on my council tax but i have to pay my rent myself. I will keep hoping another job comes up and even tho i might be skint i like working and hopefully this job might lead on to something better or just full time
