    Hi Sue, I think that might be confusing, it is only the increase in value after the date of death that will be potentially liable for CGT.
    The IHT rate, even if all within the nil rate band, will cancel any CGT liability prior to death.

    BTW, be warned that if you do chase things up, you MAY find that HMRC write to your late FIL, at his previous address. I guess they may have already done so! See my experience here.

    My experience was of telephoning, and waiting for ever to have the phone answered then being "triaged" by the Lake District call centre, and then waiting 36 hours to be called back by the relevant department.

    The conversation went a bit like this.

    Me:
    Ah now I understand , but I never got a copy of your calculation.
    [Thinks: You seem to have got it wrong in my favour]

    HMRC:
    [(Sigh) Thinks "another idiot tax payer?"]
    Can't you do the calculation?

    Me:
    Well I just want a photocopy to complete my file.

    HMRC:
    [sigh]Well the file has gone to archive........

    Me:
    [Thinks - That must be a black hole in the constellation of the Great Bear]
    Well I suppose I could try.........
