Overpaid by previous employer

I left my previous company on November 3rd and in my lasy pay they overpaid me.

I have still not received my P45 and requested it today only for them to reply asking for a refund of 140 before they send out my correct p45.

Whilst i am aware that i probably have to legally pay this money back, should i pay it back?

Would a billion pound company really take it further?
What would the repurcussions be?

I may just play the waiting game and see if they contact me, in a legal format.


P.S. I left on good terms, however I would NEVER go back to work there.

    Did you realise that you had been overpaid? If so then you should really give the money back.

    Yeah a billion pound company would probably take it further - though if its a billion pound company have they got a HR department that can sort it?

    It would probably be best for you to speak to ACAS who maybe able to help you

    Failure to repay it would be theft.

    It is down to the company if they took it further - generally billion pound companies have got to where they are by looking after the pennies.

    If you decided not to repay it they could issue county court civil case against you meaning the debt increases as you have to pay costs and interest. You have a CCJ against your name. They could also pass it to the police for a criminal prosecution (though highly unlikely) and so a criminal record too.

    Generally as it is their mistake they should be fairly reasonable about the repayment period but there is no legal requirement for them to be.
