CSA order in place and he goes and works abroad.

if a CSA order is in place, and he decides to suddenly go off and work in Dubai, i am assuming that they cannot collect from there?? what happens then?? if they cant collect from him, the amounts he hasnt paid become arrears and he owes them?? would they find him when he comes back to UK??? any advice please.

  • dont know. my god daughter is finally going to the csa this week, although the bloke has been gone for about 5 months!!!! she wanted to keep it nice and friendly, which it clearly isnt going that way. he hasnt given her a penny and there are 3 children. keeping the local landlord afloat is more important!! she was rather hoping they would take it out of his wages. the chances of him paying of his own accord is NIL. she hadnt told him anything but he has suddenly said that he is going to dubai to work in october. personaly i dont believe it and i think he has got wind from sonewhere about going to the csa. she just doesnt know what to do now. i have to hope that having a CSA order in place, he will have to pay her whether or not in the uk. but just dont know. never had to do this myself.

    The starting point is a court order for maintenance in the UK. if I recall, they do not cover Dubai but if he is in debt and she tries to pursue him in Dubai, he gets into real trouble.

  • Hello OP, I started a thread about 18 months ago about REMO. Dubai is not a REMO country, unfortunately-that said, there are ways and means once he gets back to the UK (if he is gone?). Can you give any more details, has the NRP gone to work there, if so, how long has he been there, does he have strong ties to the UK (property or does he visit UK frequently?)

    A CSA order isn't the same as a UK court order, and if you have nothing else, I would apply for that. Have a read through the REMO thread, I'm not sure how to post a link, but if you search REMO on this site, it will direct you.

    The crucial thing I've learned, is a UK court order is a must. Feel free to send me a pm if you don't want to post details.

    I hope she doesn't delay, and don't tell the CSA he is in Dubai, they won't entertain her if she does. Does the NRP have a UK address, that is what the CSA will need if she is planning to go to them.
  • no he hasnt gone yet. and personally, i dont believe he will. i think he has got wind, from somewhere, that she will be approaching the csa and he is saying it to frighten her off - if she thinks he will be going abroad then whats the point!!!!

    she should have done this ages ago but wanted to keep it nice for the kids, but this clearly isnt going to happen. as i said before, he hasnt given her any thing - no, he gave her half of the money to get the car MOT'd, then a week later wanted it back cos he didnt have enough money to go to the pub. he isnt even contributing to the mortgage.

    she really has got to get real about all this. he has a half decent job and earns a reasonable salary. thanks to all for the most useful replies.

    The other thing to check is if the company he is working for has a pay office in the UK. If they do then a DEO can be imposed and enforced.

  • so many helpful answers!! thanks to you all. i have got all this stored and have passed it on to her brother, who is gradually talking her round to doing what she HAS to do. she is struggling badly and a couple more months and she is likely to lose the house. silly girl. girl?? she is late thirties so quite a grown up person, alledgedly. she hasnt even seen a solicitor!!!!!!!!!!!! have told her that i will go over there and sit on her, and put the phone in her hand!!!!!

    From experience, Dubai is part of the UAE and does not REMO with the UK on child support and taxation because Child Support is still classed a British tax. This is because UK legislation discriminates NRPs by depriving them of child tax credits to help towards their children while the UK gives tax concessions for cohabiting parents.

    Many NRPs disappear and pay their taxes elsewhere when they are chased away by the CSA. The flip side is the CSA has previously disregarded written notices of change of circumstances when they receive mail from within the UAE, and any current liability may continue as though he is still living in the UK. However, child maintenance is unenforceable while he is in the UAE.

    Interestingly, Liability Orders cannot be used in a committal proceeding because the CSA cannot serve the document on the NRP because there is no UK address to serve it on under s.34(2) of the Child Support Act 1991, and the debt may lapse under Section 2 of the Limitation Act 1980 and cannot be revived after a period of 6 years.

    Finding work in the UAE is easy so long as you are well connected, and as a westerner, it’s well paid and you can live in the UAE comfortably and cheaply.

    Many NRPs work in the UAE to ditch their UK income tax liability and exchange it for Child Support so they are no longer taxed twice, or they want to amass a tax free lump sum.

    UAE banks do no cooperate with UK tax authorities, and bank accounts can even be numbered accounts which stop authorities knowing who the account holder is. They are harvesting the Swiss bank market after the UK-Swiss bilateral agreement on UK tax dodgers holding accounts there.

    If he works for a British company in the UAE then a DEO could work. If it’s a UAE company with an office in the UK then a DEO will fail. This is because the payroll for UAE based employees is always based in the UAE. There is no way of finding out his salary and it’s usually in Emirati Dirhams.

    The only way with your NRP on child maintenance is negotiation. He wont be short of cash and its all tax free.
