Solicitor searching credit file?
~BB~
Been made executor in a will.
Noticed on my credit file that the solicitor firm handling the will have made an 'enquiry' on my credit file, what does this mean?
Now I'm worried that I won't be able to be an executor and my BR staus will be revealed!!
I'd appreciate any help, thanks!

For Money Laundering reasons they will need to ID you - that is frequently done online via one of the credit reference agencies - its not a credit check, its an ID check via a credit agency. These days its simpler than asking for passports etc which can get lost in the post. I'm afraid I have no idea whether your BR status will stop you being an executor, or whether it will even be revealed.Adventure before Dementia!0

Thanks

Do you know what kind of information would they seeon an ID check?0 -
Would depend which system they use - there are two - 192 and callcredit. Don't know about the latter, however 192 is set up to either show a pass or fail - according to criteria set by the using firm. Typically that will be that they want you matched to two sources of information - e.g. 2 from electoral roll, phone book, credit reference etc. If you match two or more it will give a green "pass" indication - if not it will put it as a refer for someone higher up in the organisation to check. You can look at more detail as to what records its matched you to, but not the details of what those records show (if that makes sense). However I should imagine very few people ever go that far as its not likely to be of interest.Adventure before Dementia!0

Quick answer to help you, from the rule book of the Official Receiver:
25.24A Acting as Executor of a will
There are no restrictions upon an undischarged bankrupt that would prevent them from acting as the executor of a will.0 -
Hello mate
I have been an executor in a will as a BR.
As already pointed out you can remain an executor but it can be problematic if any charities are included in the will. I signed letter declaring that I would step down as executor to avoid any nastiness. Apparently some charities think that because your BR your on the fiddle and they go to court to contest YOU...!
Also if you are to benefit (assuming you are) you can get a solicitor to protect your inheiritance should the worst happen before you are discharged (meaning it goes to OR).
Don't make the mistake i made and not mention it assuming that my relative was going to easily outlive my discharge date. Its time to nut up or shut up......!
