On a payment plan company took money outside it

I have just started on a debt management plan to get everything in order and all of my creditors are aware of this and are waiting on the paperwork to go through.

However one of my creditors has just taken a large sum of money out of my account outside of this agreement (and in the process just screwed up another payment to the taxman) so am I able to force them to hand that money back since it was not agreed that they could take it?

    Who was the creditor who took the money? Who do you bank with? are they connected banks?

    If they are then they are allowed to offset money in your current account to pay other debts with the same bank if you are in arrears.

    Payday loan companies will always try to take the funds you owe, and its in the agreement that they can do this.
    The only way to stop them is to open a new bank account with an unconnected bank and empty the account that they have the details of.
    Did your DMP company not advise you to do that? This thread might be worth a read Dealing with Payday Loan Companies

    If you have any more debts with payday loan companies you need to open a new bank account and close your old one down (or empty it) straight away.

  • As Tixy said, with PDL companies, you're stuffed. They're the worst legal company to possibly get involved with, and realistically, you don't stand a chance of getting it back.
