Soooo if the house were in positive equity this could be done?
My nana just passed away but has left me a share of her house (about £35k). If I paid say £10k off the mortgage or more would it then be considered?

More likely to be considered. Though you would still need to be able to meet the mortgage repayments.

Is your ex be paying you £50pw of his own free will or under the auspices of the CSA?

It's his own free will. I looked on the CSA website and it said he should be paying £57pw! Couldn't believe it.
I've done all my income and expenditure. Including tax credits, overseas allowances and maintenance I bring in £2722 after tax. My outgoings (essentials reach barely £1000). I put £50pw away in savings. I can more than afford the mortgage just a case of whether benefits are taken into account.

Sorry. Edit to say. Those figures are per month. Overseas allowance is the money I receive (96% tax free) for when I'm working (I'm long haul cabin crew). It's guaranteed. It's my job.

Company not in position to offer a deal as they have folded (Mortgage Express).

One cherry you could offer your ex is to take on the negative equity on the property. As by using your inheritance to reduce the mortgage balance. You would then need a 80% - 85% mortgage from a new lender.
  • Not sure I understand what "take on the negative equity" means (bit dim with these things I'm afraid)

However not everything so strauht forward. Credit rating non existent. Joint bankruptcy in August 2008 with joint debts totalling £24,000. All bloody his of course but as his wife I couldn't have them pass over to me so had to go BR with him
Maybe this IS one for the brief! Pass the wine please......

Ah. That makes matters more complex. The inherent danger with forum boards!

Hopefully you feel more reassured though. As as things stand. The children as I said earlier will be the primary concern of the court.

    Hope all goes well tomorrow.

Do post back at a later date and let us know how things pan out.
  • Thank you so much for all your help tonight. I just want to be free of him. I'll post back tomorrow evening what the mortgage company and my new solicitor says. Thank you x

Hi, Just wanted to lend my support - what a @*!#!!

You have been separated sometime and he just cant let go can he! Definately one for the brief! so you know where you stand.

I would be very interested to know in regards to the issue - could he legally just turn up, let himself in and start living there again! I am pretty sure he cant so not saying this to worry you but just wonder what could be done about it.

I would be calling the locksmith first thing in the morning anyway - you dont want him snooping round the house!

    GOOD LUCK!

Do not use any of the money left to you by your Nan to pay off part of the mortgage ! He could be entitled to half the equity.
Stay where you are treat the property as if you were renting which at £240 a month is cheap and build up savings in a seperate account perhaps in your mum,s name!!
