about the postdated cheque I had given. Please help.

I had never done this so I seem to know nothing about this.

We needed windows ASAP so we agreed with a company to do windows for which we will pay thru postdated cheque dated 2 weeks away.

Now the money which should have been with us has unfortunately taken a wrong turn and we are stranded. We had made other arrangements but cannot pay by this week[the cheque is due this week]. We are planning to talk to the company and take another weeks notice.

Please advise me what would happen if something that I am not able to foresee... what would happen if the bank finds the cheque bouncing?
tomorrow asap I'm planning to cancel the cheque I had given... Is this illegal or will it get me into trouble or is it a good idea???
is there someting I'm overlooking in this issue???

  • Firstly, speak to the company, they may accomodate you.

    If you cancel the cheque, I imagine it could be seen as obtaining property by deception but I'm not too sure :confused:

    How would you feel if you were the business that had done the work and accepted a later payment as goodwill - you probably wouldn't be very happy.

    phone the company and explain first thing tomorrow . Apologise like you have never apologised before . They WILL listen . Really they have no choice , the windows are fitted and all they reall y want is paying . Just ask them to not put the cheque in the bank for another month ( to be safe) . Phone the bank as well .
    You havent broken the law at all , dont worry .

    Hi,

    First off, I wouldnt worry about about any 'criminal' charges. You were not 'dishonest' in trying to deceive anyone, and have just run into some finacial trouble - which we all do from time to time.

    Speak to the company - I would be very, very suprised if they dont mind waiting another week - but they might say the cheque has gone anyway.

    Then speak to the bank. When Ive bounced cheques, the first time they present it and then it gets presented again about five days later - but the bank should be able to explain all this. Of course, youll be hit with bank charges for all this!

    If you cannot pay, even when the cheque is presented a second time, then the bank will bill you the relevant 'bounced cheque' charge but that will be the end of the matter with them.

    Of course, the window compay will still want their money.

    In fact, thinking about it, if I did pick up any bank charges I might be tempted to take them out of the outstanding balance for the windows, depending on how helpful the window company is.

    You might think they did you a favour by taking a post-dated cheque, but having worked in that industry, I would say - I doubt it!

    Anyway, thats my idea - could be wrong - but Im sure someone will correct me if needs be, and the bank should be able to answer this anyway.

    yes make the calls, apologise profusley and if they have any sense at all the comapny will delay paying them in.

    as an aside we had a major problem with a post dated cheque a while ago, for a school trip. We were told it would be fine to post date, so we did for OH payday (about 10 days away) The school paid it in on the day they recieved it. We incurred bank charges like crazy -I wasn't expecting it to go in and so hadn't kept an eye on things, it cost over £60 to bounce a £44 cheque.
    Then she disn't get aplace because it was over subscribed.
    The school refused to refund the charges they caused us as they have "no funds" the bank claimed post dating a cheque was not enforable, and as soon as it was written it was valid.
    Yes I will be claiming bank charges back as soon as the other charges claim is sorted (I can only cope with one at a time....)

    Thanks everyone for your advise. My hubby has gone to the windows company to talk. I really hope everything gets sorted.

    Thank you all very much for the support.

    We arranged for 1/4 th of the amount of the cheque we earlier gave and my husband offered them this cheque and explained the situation.
    The windows company was happy to accept and its now agreed the remaining payment will be made in a week or two. they also returned the cheque we gave earlier. It was so easy.

    I feel releived.
