  • I think I would be hard pressed to read that into it, this letter is from the Trustee who states "Accordingly you should be in no different position than any other individual pursuing these claims." Hope I'm not held responsible for any wrongdoing.

    That's not "reading it differently", that's adding an entirely different sentence of your own construction!
    If those were indeed the exact words used in the letter, then Troosers' Trustee has to take responsibility in this.

    Did you actually use the Claims Company recommended by the Trustee? If you did, I'm certain that letter from the Trustee will absolve you from any blame...

    The letter only said he is entitled to claim the PPI, it didn't say anywhere that he was entitled to keep it. People do claim the PPI themselves sometimes and then hand it over to the OR, that's quite common.

    You may well not hear anything if the trustee is unaware. You need to inform the Trustee of your claims and the results. You do have a legal duty to do so.

    If it was me I would talk to the trustee to clarify. If they confirm again that they don't have an interest, then you should have more confidence in that.

    Otherwise I would have that nasty thought in the back of my mind that this might come and bite me on the backside a few months or years hence.

    Slightly different but how does it work for refunded bank charges? I was made bankrupt in scotland 2007 and discharged 2010. Today I received a letter from RBS who I held an account with previous to bankruptcy and was closed. I held no overdraft nor loans or credit cards, but in all the years I incurred lots of bank charges for unpaid direct debits etc.
    Ive never held PPI with the bank, nor have I made any claims, but this is obviously money I am ENTITLED to because I was charged more than was found legal when the bank charges issue went to court.
    But because Im a discharged bankrupt does that mean it will go straight to insolvency practitioner?

    You do know the banks won the bank charges court case, the banks merely lowered the charges so it didn't appear quite so "outrageous".

    no Krisdorey I didnt follow it too closely, at the time all that hoohaa happened I was having personal issues so didnt follow it too closely. Am I entitled to the refund of the charges Ive already paid?

    Any refund of bank charges would work on exactly the principle as ppi
