Terms and conditions for the Gadget Giveaway (the "Prize Draw")

1. The promoter of this Prize Draw is Expedia.com Ltd (company number: 03847519) ("Expedia ") whose address is at 42, Earlham Street, London WC2H 9LA.

2. Participants must be at least 18 years old and legally resident within the United Kingdom. Employees and agents of Expedia, Hotels.com L.P. ("Hotels.com") (or any of their subsidiary or affiliated companies) and their immediate families and members of their households, and anyone otherwise connected with operation or fulfilment of the Prize Draw are not eligible to take part. Expedia reserves the right to require participants to prove that they are eligible. If a prize winner is found to be ineligible, Expedia reserves the right to award the prize to another participant and to require the return of any prize already awarded.

3. The Prize Draw commences at 09:00 UK time on 2 September 2011 and all entries must be received by 23:59 UK time on the closing date of 23 September 2011.

The Prize Draw will be promoted on the Hotels.com Facebook Page at the following URL address: http://www.facebook.com/hotelsdotcomuk (the "Website"). To enter the Prize Draw participants must "like" the Hotels.com Facebook page and then enter their name and e-mail address as directed on the Website. Entries submitted by any other means will not be accepted: only those submitted via the official method of entry. Any illegible, incomplete or fraudulent entries will be rejected. Entry to the Prize Draw is free; no purchase is necessary. Participants may make a maximum of 1 entry per day into each Prize Draw. Any entries in addition to this may be disqualified.

4. There are four (4) prizes to be won: one (1) Apple iPad 2, and three (3) Amazon Kindles. Prize winners are responsible for paying all associated costs that are not specifically stated in these Terms and Conditions. Prize winners are also personally responsible for any personal or incidental expenses and any VAT, national and/or local tax liabilities incurred in claiming or using a prize. The prizes are as stated and are non-exchangeable and non-transferable. There is no cash or other alternative to any of the prizes in whole or in part. By participating in the Prize Draw, participants agree that the prizes are awarded on an "as is" basis, and that neither Expedia, Hotels.com nor any of their subsidiary or affiliated companies, make any representations or warranties of any nature with respect to the prizes.

5. The prize winners will be the first four names chosen at random from all complete, eligible, properly submitted entries received before the end of the applicable closing date. The first name selected will win the Apple iPad 2 and the next three names selected will each win an Amazon Kindle.

6. The prize winners will be notified no later than 30 September 2011 by email. Prize winners may be required to submit valid identification before receiving their prize. The prizes will be sent to the prize winners by post to a postal address within the UK notified by the prize winner in advance. If a prize winner refuses or is unable to provide an eligible postal address for receipt of their prize within 14 working days of initial correspondence, Expedia reserves the right to conduct a further random draw to award their prize to another participant. If a prize winner has not claimed their prize by the date specified in the notification of winning, Expedia reserves the right to conduct a further random draw to award the prize to another participant.

7. In the event that, for reasons beyond Expedia’s reasonable control and not related to a prize winner, Expedia is unable to award a prize as described in these Terms and Conditions, Expedia reserves the right to award a prize of a similar nature and an equivalent value, or at its sole discretion, the cash value of the prize. In the event of a printing or other error resulting in there being more winners than prizes for the Prize Draw, Expedia reserves the right at any time to allocate the available prizes through a further draw or to divide the prizes or the value of the prizes between the winners of the Prize Draw.

8. The provision of the prizes does not imply endorsement by Expedia or Hotels.com of Apple or Amazon or any other third parties concerned in any way with the Prize Draw. Any complaints or queries relating to the use of a prize should be directed to Apple or Amazon, as applicable.

9. By entering the Prize Draw, participants agree to have their name and Facebook profile picture featured in publicity materials relating to the Prize Draw without further reference, payment or other compensation. This includes making their name as a prize winner available on the Website between 23 September 2011 and 23 October 2011. Details of the prize winners will also be made available to participants and the public on request by sending an email to [EMAIL="hotels@wearesocial.net"]hotels@wearesocial.net[/EMAIL] no later than 15 October 2011.

10. Expedia and Hotels.com will collect and process participants' personal information in order to conduct the Prize Draw and it will be shared with Expedia's agents to the extent necessary for the prizes to be delivered to the prize winners. If participants do not provide any of the mandatory information requested when entering the Prize Draw, they may not take part in the Prize Draw. Participants' names and other personal details from their entry to the Prize Draw will be collected and stored by Hotels.com and held in accordance with the applicable privacy policy in place from time to time (see http://www.hotels.com/customer_care/privacy.html).

11. Expedia reserves the right to modify, cancel, terminate or suspend the Prize Draw in whole or in part, at its sole discretion, if it believes the Prize Draw is not capable of being conducted as specified within these Terms and Conditions or in the event of a virus, a computer bug or unauthorized human intervention or any other cause that is beyond the reasonable control of Expedia that could corrupt or affect the administration, security, impartiality or normal course of the Prize Draw. Neither Expedia, Hotels.com nor any of their subsidiary or affiliated companies are responsible for any condition, circumstances, losses, failures or delays caused by events beyond its or their control such as (but not limited to) the acts or defaults of any supplier selected by Expedia to provide the prizes or otherwise that may cause the Prize Draw to be disrupted or corrupted, or that may lead to loss or damage of the prizes in transit to the prize winners.

12. Save where they have been negligent, Expedia and Hotels.com will not be responsible for any damage, loss or injury resulting from participants' entry into the Prize Draw or their acceptance and/or use of a prize, or for technical, hardware or software failures, lost, faulty or unavailable network connections or difficulties of any kind that may limit or prohibit their ability to participate in the Prize Draw. Expedia and Hotels.com will not be responsible for any lost, damaged, defaced, incomplete, illegible or otherwise unreadable entries. Proof of posting is not proof of receipt by Expedia of any entries. Nothing in these Terms and Conditions shall in any way limit Expedia's or Hotels.com's liability for death or personal injury caused by its negligence or for any other matter where liability may not as a matter of law be limited.

13. Any participant who enters or attempts to enter the Prize Draw in a manner, which in Expedia's reasonable determination is contrary to these Terms and Conditions or by its nature is unjust to other entrants (including without limitation tampering with the operation of the Prize Draw, cheating, hacking, deception or any other unfair playing practices such as intending to annoy, abuse, threaten or harass any other entrants or Expedia and/or any of its agents or representatives) may be rejected from the Prize Draw at Expedia's sole discretion. Furthermore, where such actions have significantly impaired the Prize Draw, Expedia may, at its sole discretion, add further stages to the Prize Draw as it deems reasonably necessary in order to resolve any problems arising as a result of such actions.

14. This promotion is in no way sponsored, endorsed or administered by, or associated with, Facebook. Eligible Entrants understand and agree that they are providing their information to the Promoter and not to Facebook. By entering this competition, each Eligible Entrant releases Facebook from any action or claim arising out of the competition. Any questions, comments or complaints regarding this competition must be directed to the Promoter, not Facebook.

15. All Expedia's decisions in relation to the Prize Draw are final and Expedia will not enter into any correspondence with participants.

16. These Terms and Conditions are governed by English law. The courts of England and Wales shall have exclusive jurisdiction to hear any dispute or claim arising in association with the Prize Draw or these Terms and Conditions.
