Hounded by CAPQUEST

I am being pursued by this ruthless debt recovering company callled CAPQUEST for an outstanding amount they say I owe ! which I settled in 2009 with the original loan company over 3 years ago.

I have had no correspondance from the orginal company since I settled the debt in 2009, now I am recieving threatening letters from this company CAPQUEST stating they are going to seek a bankruptcy order against me! I have written to them asking for information of this alledged outstanding amount, but todate they have not forwarded the information I need to sort this situation out.

I have now contacted the original creditior asking them what this amount is about, they have asked me to put it in writing which I have done today. I have not had any correspondance from the original company for over 3 years so assumed the account was clear when I paid the amount to settled the account 3 years early.

I am in the process of buying a new car but have been declined the credit due to a DEFAULT NOTICE THAT CAPQUEST HAVE REGISTERED ON MY ACCOUNT. This has put me in a terrible position as I need a car for my job. I am feeling very stressed and depressed due to this situation and connot function in my daily demanding job.

I have checked this company out and they seem to ruine a lot of peoples lives they wont listen to reason just keep sending threatening letters and phone calls. HOW TO I GET THIS DEFAULT REMOVED AND HOW DO I DEAL WITH THIS TERRIBLE COMPANY. FEEL ON THE EDGE NEED URGENT HELP.

    Hi, this happened to my partner. He paid off a debt with HBOS as they sold it on. Capquest took it on and they were a disgustingly run company. We sent them letters from HBOS stating that the account was closed but it made no difference.

    We called the ombudsman helpline for advuce. They said that we had to go through the complaints procedure with the company who sold on the debt, get it to deadlock the they would take over it. It took 3 years and Capquest still registered a default on the account.

    We eventually got it sorted and equifax removed the default. Its inconvenient and annoying but stick with it. Good luck.
  • If you are able to fax a complaint to the Capquest today. The number is 0844 2499696 (assuming you have a fax modem).

    "Dear Sirs


    Reference number: XXXXXX - Complaint


    I am complaining that you have are pursuing me for a debt with [name of creditor] which I settled in 2009. This is a criminal offence under the Protection from Harrassment Act 2007.

    Further, you have libelled me by falsely registering a default in my name. As a result, I have been unable to obtain credit in order to purchase a car which I need for my job.

    I therefore demand that you immediately remove the default record from all credit reference agencies and compensation for the distress, embarrassment and inconvenience you have caused me.

    Furthermore, should I lose my job as a direct or indirect result of your libel, I shall expect you to compensate me for loss of earnings.

    I understand that, as a condition of your Consumer Credit Licence, you must comply with the rules of the Financial Services Authority in addressing any complaint you receive and would remind you that you must acknowledge this complaint in writing promptly.

    You must then issue a response, in writing, within 8 weeks of receipt. As I am sending this letter by fax, the 8 weeks starts today.

    The response must tell me what, if anything, you propose to do to rectify the matter complained about. It must also inform my of my right to go to the Financial Ombudsman Service and include a copy of the booklet "Your complaint and the Ombudsman".

    You may make no charge for dealing with my complaint and, should it be necessary, you must comply with any award made against you by an Ombudsman up to £100,000 or, should I complain to the Financial Ombudsman Service on or after 1 January 2011, up to £150,000.

    Should I lose my job over this matter, I shall seek the full £150,000.

    I look forward to hearing from you as a matter of the utmost urgency.

    Yours faithfully"


    I would send a similar letter to the original lender. One solution for them may be to lend you the money on no less favourable terms than whoever you applied to for credit (including rights you would have had under the Consumer Credit Act if the loan was being arranged by the dealership).

    Again, faxing is good - not only does it arrive instantly but you get a receipt.

    In theory, FOS could award £150,000 against each. In practice, you would probably receive an amount considerably less than that as it is reasonable to suppose you would find alternative employment. However, a little bit of sabre rattling is not going to do you any harm at this stage.

    i've addressed letters to them as that and used that name when on the phone to them

    they got quite upset :D

    DONT deal with them on the phone though. i was just having fun

  • Thank you for all your advice I will send the fax suggested to CRAPQUEST AND THE ORIGINAL COMPANY. thank you magpiecottage for your professional help.

    I have also contacted creditexpert who I am a member of they have advised to to email them stating I want a Correction Notice against the default with the reasons why, which I have done.

    I will also contact the financial ombudsman with my complaint against Crapquest!!!

    I have read alot of complaints against this company I cant beleive they are allowed to keep doing this to people and why they have not been stopped.?? My credit file was good showing every thing either settled or all payments made on time now it shows POOR !!! It will take me along time to regain my good report.

    FOS will not get involved until they have either given you a "final response" to your complaint (which says you have six months to go to FOS) or 8 weeks have passed since the complaint was received (hence the fax receipt of proof of posting).

    They will also not get involved if they think it obvious that a fair offer of redress has been made.

    However, if they DO get involved they will charge the firm £500 (it is free to you).

    Furthermore, if they find a DCA repeatedly having complaints of this nature upheld FOS will report this to the OFT - who can withdraw the DCA's consumer credit licence, effectively putting it out of business.

    I have spoken to the CAB who have advised that I get a full statement of the account and all the payments and final payment I belive I have paid.

    I have also asked the same of this Capquest Company, I have contacted the compliants department of the original company to complain that if there was an amount outstanding why have they not pursued me them selves so I was able to pay and sort out ????

    3 years have passed and they have not contacted me in that time so I assumed all was paid and cleared why would I have paid £6,467.00 to clear the amount and left any out standing amount!!!! it makes no sense.

    This is completely wrong if the company gave me the wrong amount over the telephone then I only owe the outstanding amount at the time I thought I settled the account.

    They have not bothered to contact me for 3 years. I have moved address and had my mail re-directed for 2 mths, I am on the electrol register and pay my council tax, I am also in the phone book?

    If CapQuest could find me after 3 years there is no excuse for the original company not to find me and make contact to resolve any outstanding amount I owed. I paid what they advised at the time by my debiet card over the phone and would not have not paid the full amount!. I would have no reason not too, I have been off work with all this stress. Hopefully now I have made a formal complaint against the original company they will take it forward. They did seemed concerned that Ive have had no contact from them for 3years ? I also think they have added interest and late payment charges to the account over this period of time.

    Have I got a case against them if there was any outstanding amount which was there error if they gave me the wrong settlement figure and because they have not made contact with me themselves to resolve ??

    Please help I am doing all I can to get this DEFAULT off my account!! I am unable to function at work which is effecting my work load and will be noticed soon by my line manager i'm sure. I'm trying to keep going, but I have to hand back my car to the lease company now in fact thins week as I dont want to apply for credit to keep it and be turned down again due to the DEFAULT notice. Then I will have no car !!! can borrow a old banger from a friend in the mean time but this is not a long term solution as I have to travel alot of miles in a week.

    Thanks for helping, any more advice would be greatly recieved many thanks for your help so far.
