hours going to be cut

wondered if any of u kind people could give me some advice.

my hours sound like they MIGHT be halfed at work from 40 per week to 20

this will half my income.

i currently pay cccs 776 pm and have paid off 27900 off my debt so far.

im worried that im not gonna be able to afford to live let alone afford my dmp does this mean BR.

i'm arranging to move into my girlfriends parents house with her. to save rent etc. but i may be stuffed and its dead quiet out there work wise.

any help from you kind people would be great

  • they should have "consulted" with you over this for at least 30 days and then you should have another 30 days notice. This gives you 60 days to start looking for another job (I am in a similar situation)

    Check you contract first to see if it says anything about hours- if they are clever you will have a contract which states you work various hours to suit business needs

    Presuming you have a 40 hour per week contract, if you don't agree to a change in contract the have two choices: 1. go ahead anyway or 2. dismiss you and rehire you under the new contract.

    Cutting from 40hours to 20 hours is a very drastic change and I've seen organisation's lose employment tribunals for less. The tribunal will look at factors such as how the proposed change was communicated, whether adequate notice was given and the advantages of them making the changes. Are they making changes to anyone else's hours?

    Do you have a union? I would recommend speaking to them if you do, if not get an appointment with the CAB or use the free half an hour with a solicitor.

  • If you can prove you regularly work more than 40 hours a week and your pay will more than half it's something called short time working. As an HR person I've never come across it personally but at a recent employment law update I attended we were advised that it carries further implications as the employee may also be able to claim constructive dismissal AND redundancy.

    Quick internet search gives the time frame as 4 or more consecutive weeks or a 6 weeks out of 13.

    Your best bet might be to let them make the changes but make it clear you DON'T want to work 20 hours, keep looking for another job (20 hours is better than nothing) and seek legal advice.

    Making it plain you dont want the changes - now that is something that would have to be done in writing (with a copy kept) and proof that they have received it (eg send it to them by Recorded Delivery - rather than handing it over the shopfloor to them personally).

    My own personal decision in those circumstances would be to resign (explaining exactly why in the letter) and then sue them for Constructive Dismissal and Redundancy - but thats me and thats in my circumstances (ie not that reliant on having a job any more). Your circumstances will be different.

    I suggest you visit the Employment Board on this Forum to ask for further advice.

    I don't really work in the industry where u can refuse things and take people to court. I would lose a good reputation thats took me a while to build up.

    My options are work twenty hours and find another job or get the boot completely and then find a job.

    In a positive way I may not be outta work for long but you just dont know. My concern is how it will effect my Cccs dmp and whether I will have to go br and would I be accepted to go br especially if I walk out.

    Speak to the CCCS and advise them what is happening. You cannot carry on paying what you do not have. They will be able to advise you on the best course of action.

    Hi CCCS will be able to offer advice. They'll do a new budget with you and work out what you will be able to afford to pay. If your living costs will also reduce hopefully you'll still be able to afford something towards the DMP?

    If you can afford more than £100 a month then they would continue to run your DMP and would contact your creditors to explain your change in circumstances. Then once you find more work or a different job you could then increase your payments again.

    If you can't afford £100 a month then they may either suggest you just make token payments until things improve or may suggest you do consider other options, possibly including bankruptcy.

    Best things to do is talk to them. Good luck with job hunting.
