Amazon Cancellation Of Orders

Options
Hi,
I have had alot of orders cancelled recently from on-line companies, claiming that item was priced wrongly. They hide behind their pricing policies. Is it worth pursuing them & will I get any compo if I cause enough fuss

Any thoughts
Andy

  • there's power in numbers. Amazon are pants for mispricing, and should be strung up, along with Tesco. But they all have plenty of money and no local authority in the land is loaded enough to bring them to book on a regular basis. But persue it if you have the time and energy! Go for it!

I have had orders cancelled recently:

Tesco - Out of stock (PS2 game and DVDs)
    Amazon - Misprice (DVDs)
    Play-Asia: Misprice (DVDs)

On the one hand we can jump up and down and wax lyrical about not getting the item at the price we "purchased" it at, but on the other hand do we really expect these companies to provide items that sometimes appear below cost, when boards like this and HotUKDeals must bring in huge volumes of orders.

My only gripe about my orders was the Tesco one. No excuse for not having enough stock. Why don't they get a Lynx Clicker...499...500...right, stop taking orders as we only have 500 of that item.

    JMHO.

had amazon taken your money then it would been a binding contract and would have had to send them, and because of there automated email when placing order, it states order confirmation, but does that mean order taken an payment taken or just they have recieved your order. Very grey area. But if they had taken your money, then you would have had the dvd's
Mansion TV. Avoid at all cost's :j

That doesn't even work mate. Alot of us had money taken with the B&Q debacle of 2005, but still got no joy as far as getting the product. And Argos and Homebase both took money (to the tune of 43p:rotfl: ) when we ordered tvs. They still won't give you the item, they'll just refund the money.

My issue is they should have procedures in place NOT to misprice. And if they don't, and the consequence is someone orders at a ridiculously cheap price, they should honour it and learn from their mistakes. But they don't. They continue to misprice, over charging and under charging, but only really caring about the under charging!

I recently ordered the Robosapien from Tesco Direct when it was reduced to £19.99, they took my money and 4 days later (after it was supposed to be at the store for me to pick up) refunded me as it wasn't in stock.

I went into the store and made a fuss, and was put through to Dundee on the phone. After about 15 minutes of me saying that this is very bad selling practise, I thought I had the item and so missed out on other offers that were around blah, blah, she spoke to her supervisor. Net result, they will honour the lower price if I re-order when it comes back in stock.

Now, I reckon they either know they aren't going to restock, or they think I won't keep checking online.... What do you think?

Sorry, but if the companies make genuine mistakes, what is the issue?

Seriously guys, there is no such thing as a free lunch.

I personally think Amazon, Tesco, etc should cancel orders if the price errors are genuine. Oh, also, read the T&Cs that you sign up to re these price errors, the companies are normally covered.

The issue is the companies shouldn't be making "genuine" mistakes on a regular basis. They are meant to have procedures in place to ensure all prices are correct.

Traders are breaking the law when they misprice

To be honest, the big companies are all pretty useless at this and not just online.

The number of times I've had to go back and gfet a refund for being over-charged in tesco/morrisons/asda for everyday food items is just ridiculous - indeed, tesco are so bad at pricing their food in store that they've had to withdraw their refund plus keep the item for free (mostly due to this site posting all the mis-prices I hasten to add!).

Ultimately, they are breaking consumer law by advertising one price and charging another - be it in store or otherwise. Likewise, taking money and then cancelling the order for online purchases is, in the spirit of the law, also wrong. However, the term E&OE (error & ommisions excepted) is a standard phrase used to allow businesses to 'cancel' contracts where an 'error' has occured. The law doesn;t consider more than one occurance of an error to be a deliberate tactic, even though it probably is and hence why the big boys can get away with it.

With regard B&Q. I gave them seven days to supply my childrens play frame at the price they originally charged me, despite it being 'out of stock' and after many threatening phones call to them I got it, same with e2save and their con of a cashback scheme also had me recently rattling sabres.

So to OP, threaten the retailer by all means with court action and see where it goes, but dont make it a personal crusade, especially for something that was just a few quid cheaper than other stores.

personally, i think misprices should be honoured online as they are in the high street. i went in wilkcos this time last year to buy some new school bags for my girls, anyhow i saw two i liked at half price [£2.50] so i took them to the till and they scanned through at 5p each. my first thought was their not going to accept this, but they called over the manager who said that if it scanned at that price they had to sell it at that price end of story.
i couldnt belive my luck, kept the receipt on the wall for ages
