Dear Sir/Madam,
Re: Credit card account number: XXXXXXX....

I wish to register a formal complaint regarding the manner in which my account is being managed by MBNA.

This is a list of events which have happened so far:

· I sent a letter to MBNA, dated 10/02/11, describing in detail our financial situation along with a breakdown of our income and outgoings. The only response I received was a standard letter to telephone you.

· I sent another letter dated 12/03/11 stating I was only prepared to deal with this matter in writing so proper records could be kept. No response from MBNA

· As the matter was clearly not going to be addressed by MBNA, I sent another letter dated 04/07/11 requesting that you look into the case and send a proper response. I also point out that by adding on continuing charges and interest, that MBNA was breaking paragraph 225 of The Lending Code, a code which MBNA claims it subscribes to.

· I then received a letter from MBNA dated 14/07/11 stating that the matter was being investigated and that I would receive a reply by 04/08/11. This reply was not forthcoming however an apology letter was received from MBNA dated 02/08/11 from a Rachel Nixon apologising for the delay and that a response would be issued by 30/08/11.

It is now 31/08/11 and once again I have no response from MBNA regarding this matter. From the first time I contacted MBNA regarding our situation, they have failed on every step to supply a proper response and to make any effort to bring the situation to satisfactory resolution.

I have sent regular monthly payments since first contacting you of £100 per month. Although this is below the ‘minimum’ it is all we can afford at present and yet still, you are continuing to add charges and interest at a very high rate.

May I remind you again that MBNA Europe are subscribers to The Lending Code. Paragraph 225 of the code states:

225.
It is inappropriate for interest and charges to continue to be taken where the result would be that the repayment period for the customer becomes excessive. In forming a judgement on what might be excessive, a subscriber should take into account the type of product and the individual circumstances of the borrower.

It is my opinion that MBNA have failed in their duty to adhere to this code.

Since MBNA do not seem interested in resolving this matter I am lowering the payment I make to you to a token £1 per month as from the date of this letter. I will be happy to increase the monthly payments back to their previous level when MBNA addresses the following points:

· To freeze all interest and charges on the account
· To refund all interest and charges incurred since the date of my first letter to you, dated 10/02/11.

May I remind you that the MBNA account is just one of several we are currently indebted to and that all our other debtors have not only responded in a timely and helpful manner, but have also agreed to the freezing of interest and charges subject to periodic review of the situation.

I am appalled at the indifference shown to genuinely difficult circumstances by MBNA and the tardy manner of it’s replies.

LOL - I just got back from the Post Office, sending that letter Recorded Delivery. What do I find? A letter from MBNA dated 25/08 saying they're accepting the conditions.
