I am fairly new to this forum and am really hoping for some advice.
My husband is an electrician. He left his previous employment on 1st July this year and started up his own business.
He has just received in the post his P45 and final wage slip. He was owed for a couple of days work and some holiday pay.
His employer has listed the following as deduction:
Tax (obvioulsy this is fine)
NI (again, fine)
Tools (which my husband has booked out over the years, however 2 of the entries on the tools list have been since he left and have been booked out to another employee)
Van Mirror (several months before my husband left whilst driving down a country road some maniac clipped his wing mirror and it snapped off)
Tester 50% (3 or 4 months before my husband decided to leave his van got broken into on our drive and the tester was taken from his van. This alone was worth £800 and has he has charged my husband half of the cost.
This basically means that his incomings on his wage slip minus his deductions are £0.00. How convenient.
I have read through my husbands contract of employment and it mentions none of the above being deducted in any circumstance ( apart from tax and NI obviously).
I just have no idea what we need to do now. I just cannot believe this has happened.
Any advice would be great.
Thanks In Advance

If there is nothing in the contract - and no other policy that he has signed allowing these deductions then they are unlawful, and he will have to write to the employer stating this and demanding the money he is owed, or else he will make a tribunal claim. But he only has three months less a day since the date he left to make a claim, so don't get caught out of time as you have two months gone already!0

Well my husband has had to contact them several times asking for his P45 etc so that explains why he has been stalling. So am i right in saying that his employer would need to receive a letter demanding the money back by 30th of september. How long do we then give him to reply? How would he go about making a tribunal claim? Sorry for all the questions but i am just so shocked that these things can happen x0

No your tribunal claim needs to be in by 30 September. The letter can be sent any time. Don't wait for a reply to the letter to submit the claim - that won't be allowed as an excuse if your claim is late.
Details on submitting a claim are on the Employment Tribunals website here:
