Default Mess

I recently checked my credit details with Equifax and found to my horror that I have a default from 3 years ago! The circumstances surrounding it are quite disgusting and I'm not sure exactly what to do.

You see, I went into Carphone Warehouse and took out a contract for a webbook with mobile broadband. When I purchased the item, I stipulated that I would be using it constantly for work purposes and that I needed unlimited download/upload. The sales advisor assured me that the product had just that, so he bagged it up with a 3 mobile dongle and sent me on my way. After the first month I received a bill expecting it to be £20, but it was for £90!

I rang carphone warehouse and explained, they told me to contact 3. So now I was frustratingly being bounced back and forward between the two.

After a few days, I gathered up the product and headed back to where I bought it and in the heat of the moment shouted at the store manager, pointed to the salesman infront of a packed shop, called him a liar and a con artist, placed the product on the counter and told them the contract was void as I'd been lied to.

So, next thing, 3 Network are chasing me for £90, I explained the circumstances and they didn't really care for anything but their money. So, after what I think was 5 months (5 missed payments) I got a default.

So I call them again and say that I will pay the money if they remove the default which they agreed to.

But, after maybe three years, I find it's still there but account is settled.

My question is, how do I get them to remove it? Do I need to take this to court?

    did they tell you on the phone they would remove it or in writing? If on the phone, it will be pretty impossible to prove after this time I expect.

  • Yeah, on the phone, wasn't too clever looking back
  • You could try writing to them. Long shot but at least you get their official response. If they refuse I'm not sure what you could do maybe fos or ico but it will just be your word against theirs.

  • Does the default show as paid in full?

    I believe that you can put comments onto your credit file against the default - not sure how much space you get though.

    Also, not sure if anyone else knows this but do communications companies have to go through the full rigmarole(sp) when issuing a default? Did you keep any/all the letters that they sent to you from before you got the default?

  • I had a similar experience with carphone warehouse/orange, i settled a default over a year ago (dispute over moble phone which never worked), anyway bit of a long story, but i thought what the heck and wrote to orange explaining the circmstances and asked them nicely to remove the default. Much to my surprise in under two weeks they did, no notification from them, they just removed it. Although they didnt remove the late payment markers which show 12345..... I suppose its better than having a default though. Definitely worth writing a letter.....:)
