HMRC late filing penalty - can it be avoided ?

One of my friends has a limited company, which is dormant and has been so since he created it. As a consequence he has never received any income from it.

He has received a late filing penalty from the HMRC. He seems to think that it he removes (i.e. strikes out) the company from the companies register, the HMRC will not enforce the fine. Does anyone know if he is correct or not ?

He is going to appeal the fine anyway cos there were lots of issues with the HMRC website during 2 days that he tried to submit his accounts, which prevented him submitting the accounts on-line. He has also got an email from HMRC confirming this problems and for him to try again the next day. Trouble is he went on holiday the next day and, in a rush, he mistakenly submitted the wrong report. Anyone think he will get away with this appeal ?

Any advice would be much appreciated.

    Yes that's correct I just had 10 quarters of £400 fines on an old struck off company. £4,000 in total reversed. All the letters came on the same day reversing the fines. They can only enforce the fines against the company if the company has no money then that's the end of it.

    He hasn't struck off the company yet; so am I correct in assuming that once he has done this and cos the company has never received any income, the fines will be cancelled by the HMRC ?

    If he calls HMRC and advises that the company has always been dormant then they should cancel the penalties and mark the company as dormant. Once they have a company marked as dormant HMRC will not require a corporation tax returns to be submitted. Hopefully it could get sorted out in one phone call – worth a try.
