Hello

Does anyone know anything about these people? I have read a few old posts from 2006/2007 but, I have just received a txt msg from them asking me to contact them quoting a ref no! After reading that they are a debt collection agency and are very agressive I'm slightly concerned to speak to them.

I have no debt, I've had 2 cars on finance and both of which have been paid in full, never missed any payments ever. I've never had a credit card or store card etc, so I know that I have nothing outstanding!

Does anyone have any suggestions? or just ignore the txt as they've got the wrong number or something?

Kerrie

  • oh yeh but this is another thing, i have googled them and cant actually get on their website! it just comes up as it doesnt exist but they come up on the search result, so to start with I thought it might be a scam txt and was someone who was going to charge me loads of ringing them!

so I have no clue what their address is?

If you have no debts then its probably just them fishing for information or trying to find someone with the same name as you. Or if they didn't mention your name in the text then just a mistaken number.
McHall are well known for trying a scatter gun approach to try to find debtors of very old debts.

As its just a text I would ignore, if they write to you, then at that point I would send the prove it letter.

  • okay cool, thank you very much!!

I will ignore it! i have only had the phone since Dec last year so it might be someone else had my number before hand? I defo don't have any old unpaid debt so will just ignore it! and if they ring I will make sure I don't give them any of my personal details.

Have you tried searching this board? I think they are the most-mentioned debt collection agency. We should give them an award!

Definitely ignore. If you have no debt outstanding then I wouldn't worry about it. Chances are they'll go away, they did it to me. Twice.

MH specialsie in buying old statue barred debts beyond 6 years ago you may have some things that are 10 or 11 years old who knows or they may be trying it on , i have had dealings with them over 2 credit cards from 13 years ago

if i was you i would get your equifax credit report for £2 and check to see if you they have searched it leaving a foot print saying outstanding

if your mobile phone number is on equifax they will use it ti text you and hastle you

there is no law against a company asking for you to pay even

here is the letter i used to tell them to get lost and have never heard from them since

send it recoreded deliver to their kilmarnock office and not there post office box

    WITHOUT PREJUDICE
    Dear Sir/Madam
    Date 19/11/2010
    Account No:
You have contacted me regarding the account with the above reference number, which you claim is owed by myself.
I would point out that under the Limitation Act 1980 Section 5 "an action founded on simple contract shall not be brought after the expiration of six years from the date on which the cause of action accrued".
I would also point out that the OFT say under their Debt Collection Guidance on statute barred debt that "it is unfair to pursue the debt if the debtor has heard nothing from the creditor during the relevant limitation period".
Unless you can provide evidence of payment or written contact from me in the relevant period under Section 5 of the Limitation Act, I suggest that you are no longer able to take any court action against me to recover the alleged amount claimed.
Furthermore I will not discuss the above account by any other means other than written letter and any attempt to contact myself other than written letter will be deemed as harassment and will be reported to the relevent authorities .
The OFT Debt Collection Guidance states further that "continuing to press for payment after a debtor has stated that they will not be paying a debt because it is statue barred could amount to harassment contrary to section 40 (1) of the Administration of Justice Act 1970".
I await your written confirmation that no further contact will be made concerning the above account and confirmation that this matter is now closed.
I look forward to your reply.
    Yours faithfully

Persistent !!!!!! scumbags who fail to understand even the most basic request. If you do decide to contact them, do it in writing and if they call, don't go through the security check, tell them you only wish to be contacted in writing and hang up the phone.
If you've nothing decent to say, perhaps you shouldn't say anything.
