Handing in my notice

I've been offered another job and am thrilled. Been wanting to leave my current position for ages.

However, I was asked the question about my notice period in interview and I said as there was nothing stated in my contract, it would be the statutory 2 weeks. The thing is I've looked at my contract again and there is a paragraph on notice periods but when the contract was printed and bound, this page was in the wrong order and was at the end of the document after the signature page and I hadn't noticed it. It states that my notice period is 1 month.

My new employer has asked me to call her on Tuesday to let her know a date when I can start.

I intend to hand in my notice on Monday (:eek: scared) and I was wondering if I could ask them if I could leave early.

I've never handed my notice in before, do you get any untaken holidays? Do you get payment in lieu of these holidays?

Also, what would my leaving date be if I had to work a months' notice. Is it 4 working weeks or 4 weeks.

  • If the notice period is 1 month then it would usually be 1 calendar month.

    You would retain your minimum statutory paid holiday you hadn't taken during the current leave year, and take it during your notice period, but (depending on your terms and conditions) you may lose any holiday not taken that is in excess of the statutory minimum (5.6 weeks paid annual leave - 28 days for someone working five days a week).

    Eg. your contract gives you 30 days holiday per year including bank/public holidays. Your leave year runs Jan-Dec. You have already taken 10 days holiday.

    You give 1 month's notice on 22 August; your employment will cease on 22 Sept. The total number of days between Saturday, January 1st, 2011 and Thursday, September 22nd, 2011 is 265 days.

    265/365 = 0.726 of annual leave due pro-rata. 0.726 * 30 = 21.78 days annual leave earned. Less 10 days already taken, gives you 11 days annual leave to take. Leave would start on 12 Sept.

    If your employer makes you forfeit your two days leave additional to 28 statutory days, you would have 0.726 * 20 = 20.32 days statutory annual leave earned, giving you 10 days annual leave to take. Leave would start on 13 Sept.
