as said in my previous post, you have a right to attend and object
just make sure you take advice from somewhere like national debtline and formally submit objections in plenty of time.0 -

Thanks notoolate, I did ring the NDL and they said that I should contact a solicitor and if there was anything else they could do that I should ring them.
Well I thought that asking for what I could do at such a critical time, and wanting to know if I could attend the hearing as it is just in my OH's name was enough to ask them for help.......
I have written to the court today outlining my objections and requesting if I could have permission to attend the hearing and will wait to see what response I get.
Thank you for your advice, much appreciated.0 -
Star, please don't feel frustrated if the courts go ahead & grant the co - even with credit card debts they are almost impossible to fight - trust me - I fought tooth & nail & still got one (I kept up my repayments set by the courts & never defaulted, too). Many many people are now finding it impossible to fight against the courts granting charging orders. But as you are disabled, please POINT THIS OUT to the judge if it isn't obvious as the next step could be an order of sale...& you want HMRC's solicitors & the judge to know you are disabled so they won't be tempted down that route next as courts don't like to make an ofs on homes where people are disabled, children are there or elderly as well.
I am confused by the reposession. Is this for the same home? If so, this will change things...0 -
If you are facing repossession then contact Shelter urgently.

Hi sparklyfairy and thanks.........yes this is for the same home the repo..........no kids so cannot use that.

I have been very very busy since the last time on here.
Some good news which I would like to share with people. Last week I received a letter from HMRC as I sent them a letter literally begging them to have mercy on my situation and the terrible mess my OH left me in.
On Friday I got a letter from HMRC and they said they sent a copy of my letter to the court and will not be withdrawing from the hearing. Then the same day I had a visit from a man from HMRC who gave me a handwritten letter saying not to attend the hearing next week and the court will in touch in due course.
I have just rang the court and they advised me that the interim order was discharged and case dismissed. So all that pulling my hair out has paid off, and I had a hearing on Monday regarding the repo, court could not find the file and the case was adjourned.
All in all a very well and good result and hope that others reading my thread will take courage and not give up, no matter how bad it gets, because if I can do it then trust anyone can.
Thank you to all who advised and helped me out in my hour of need.0 -
