HMRC expired deadline

I am in the middle of helping my lodger sort out his enormous tax mess. To the point where he has given me permission to speak with them on his behalf.
Back in June he got a letter stating he owed £19k in tax dating back to 2005/6. We called up and it appeared he had not filed any tax returns since 2004.
The lady was quite helpful and explained the usual if that if the tax returns were filed then the assesed tax would be adjusted and if no tax was due then the penalties would also withdrawn.
So we set about going through his filing system( a small suitcase under the bed) and his bank account. finally got it all up to date and filed. It turns out overall he is owed a small rebate.
However yesterday he recieved a letter stating thankyou for submitting tax returns for previous years, however the deadline for filing the return for 2007 expired on 5th april 2011 and therefore my original assesment stands, now this amounts to nearly £5K.
Apparently its ok for the return for 05/06 to be submitted.
Now I was under the impression that your return could be filed at any point and that there was no way they could charge you for tax that you didn't owe, but they are adamant.
Anyone ever heard of this before or have any knowledge before I pass him on to my accountant.
