I got a letter today from one of my creditors, Nationwide, stating that they are looking to enforce debt of £2653.41 by means of CCJ. Phoned CCCS, who stated that Nationwide like to go down this road and obtain a Charging Order on property to secure their position regarding debt repayment.
CCCS advised me to monitor position and if I receive any court papers, contact them again on how to proceed.
My already low opinion of what was once a worthy organisation has now plummeted. I wonder if Nationwide are looking to clear lots of red ink off their balance sheets? Watch out folks....

Trying for charging orders seems to be getting more common. MBNA have been increasing their applications as well.
First have a read up on charging orders and the possible reasons to use to not have one granted - this factsheet is useful. http://www.nationaldebtline.co.uk/england_wales/factsheet.php?page=15_charging_orders_in_the_county_court
Is the house just yours or jointly owned with someone? If jointly owned and the nationwide debt is just in your name then read up on this charging order thread - Charging Order? The myth
What type of debt originally? (credit card, overdraft etc). How long ago was it taken out? Have you considered investigating to see if it might be unenforceable? - if it is this could prevent them getting a CCJ never mind a charging order.
If you get court papers then come and ask for advice on here as well as speaking to CCCS (CCCS usually tell you to admit the debt which isn't always the best option).A smile enriches those who receive without making poorer those who giveor "It costs nowt to be nice"0 -

Today, I received court papers which Nationwide have served, dated 24th August 2011. I will have a good read of them tomorrow. A previous post said CCCS may advise that I should "admit the debt" - not sure why I need to do this - I do owe the money but they are fourth highest out of six in terms of amount owed - approx £2800 out of total just under £18,000.
Receiving these papers has made me feel physically sick with worry.
