Personally I would ride it out, see what they are willing to do, then arrange an installment plan if/when they threaten court action

They are within their rights to ask for it and you are obliged to pay it. If it went to a small claims court, they would win.

£117 isnt a lot of money and I wouldnt think they would offer installments on an amount that small. Although you never know. You could string out as as aj3001 suggests. It can take months for them to start a court claim and that will give you a chance to get the money.

They have up to 6 years to take the money

How card systems work are fairly complicated and when you get into the situation of large established companies many have historic systems that lack many of the sophisticated elements that much smaller companies have (hell some of them lack basic card authorisation)

They could issue small claims court proceedings against you and potentially worse accuse you of taking the goods with no intent to pay. You owe them the money, you have had the items interest free for a while so would recommend you just pay up

  • this happened to my other half, took them over two months to take payment from the card and by then it had been well and truly forgotten about it. As it wasn't a cancelled card, they just took the money. When we phoned up to check if it was right (as we thought we'd paid it 2 months prior) they said the bank had been rejecting their claims to the money, which is crap as the money was there in the account all the time. Still had to pay it and no apologies for the inconvenience of them taking it just before xmas when it had been delievered in october.

£117 is a big amount to not notice, you really should check your bills more carefully too!
  • Mrbrightside - yes, that's what confused me, Capital One say they rejected no attempts in Nov or Dec, a few days ago was the first and only time Boots have tried to withdraw their funds. Yet the Boots lady denied this big time! she was snappy, yet offered no explanation or apology as to why it's taken so long to tell me.

Mrs B - I usually have a hawks eye on my credit cards, but given i overspent in the run up to xmas, i just paid off the outstanding balance of £170 to be done with it. (£170 seemed viable amount to have included the Boots order, tho i'd clearly been wishful thinking)

she's ringing me back on monday, we'll see if she gives me a bit of time to pay it all back...
