N1CPC - Northampton County Court - Regarding a Motor Claim

Hello all, hope we are all ok? I am looking to get some advice :money:

On Saturday morning (13/08/11) i received through the post a N1CPC form from Northampton Court on behalf of Judge & Priestley Solicitors acting on behalf of an individual.

The claim form is requesting £927.50 and is regarding a car accident i was involved in on September 3rd 2010.

The initial accident caused very little damage (My black bumper put a 15cm black mark on his baby blue coloured bumper), however i gave my insurance details as he said it would leave him with piece of mind. We did agree to try and sort it privately. I notified my insurance company straight away about the accident when later on that day he decided he did not wish to sort the problem privately. I was liable and admitted that also.

10 days later i received a solicitors letter threatening me with court proceedings in relation to the crash. I phoned my insurance and they said that is not right and for me to send them a copy of the letter which i did. Whilst on the phone the person working for my insurance muted a problem with the other parties insurance - his reg matched a different insurance broker to what he was going through.

This continued however this was the last contact i had on the matter. I had an online login to my insurance and the claim remained open till May this year. My insurance was up for renewal, i chose to go with a different company and during the process i had various contact with my insurance and the on-going claim was never mentioned once. I did think that once settled i would be getting a letter asking for my £300 liability.

Fast forward to yesterday and i receive the letter from the court. The individual has taken me to court via his solicitors. He is claiming:

The sum of £747 (Credit Hire) - Guessing this relates to him hiring a car
Statutory Interest of £55.50
Court Fee £55
Solicitors Fee £70

I am a little confused as to how this situation has panned out. My insurance was completely fine however i do realise i left the policy whilst the claim was still open with no objection by swiftcover, however i know this is nothing to do with my insurance this is a personal claim made by him via his solicitors against me. Surely this is what insurance is for and is something that would have been dealt with by them.

I really do not need a CCJ by my name so i guess the first course of action would be for me to extend the time needed to respond upto 28 days?

Then what can i do in this situation, can anyone give me any advice? question.gif

    pass the letter to your insurance, its standard. However they may argue the credit hire amount.
    Don't put your trust into an Experian score - it is not a number any bank will ever use & it is generally a waste of money to purchase it. They are also selling you insurance you dont need.

    I am not with the insurance i was with at the time currently. I was with swiftcover, however for the time being i am a named driver on my partners insurance. Do you recommend getting back in touch with swiftcover?

    plus with this being a county court judgement between myself and the claimant i only have 12 days to respond with action.
