providing all other pre-employment checks, including the check against the ISA list, have come back clear and complete and the CRB Application is in progress.
What ISA list? I didn't think the ISA stuff had been implemented yet?

We carry out eCRBs on all staff, and have no instructions to check any lists at any time.

ISA never got off the ground, as far as I am aware, and I believe it may have been scrapped altogether now...?

On the caselaw I quoted, it has nothing to do with the 12 month period or not. It is to show how employee status is viewed. As for the Breach of Contract, this is spot on. The view about the elephants however, shows me why the HR seem to think they can treat anybody with contempt. I have never seen this side of employment issues and I now know why most of the staff seemed afraid on anything to do with employment. And yet most had long service but they lacked confidence in their own rights. The reason I am so angry is because of how the system seems to work and treats people as nothing.

After release, I was re arrested 5 years later over a matter to do with the original case. It took another 2 years to win an Abuse of Process action in the High Court. What it learnt me was that we all have rights and we shouldnt just accept what we are told, if for one instance we believe we have been wronged.
On the conviction and relevance, I have spoken to a quite a few parents about it and have their support as they do not think it has anything to do with the job. Not one negative responce and that also goes for staff. My offence was to do with my Business at the time and when I bought equipment I had salesman who bought and sold for me as well. Everything I bought was in good faith and everyone I dealt with were companies. Arrested sept 94 and all my stock taken by police and stored along with my cars, these were not released intill aug 96. The value of the stock was next to nothing as the pentium came out in late 94 and totally changed the value of computing. Two examples for those who dont know. 64 meg of memory for an apple mac £750 trade, 9 gig avid hard drive only, £4000. Cd reader only just come out, dvd not around till 2000. Internet just starting and windows released.
Then and now are worlds apart.
As I said in an earlier post, this week I believe things will start to move and as they do, I will post.
    thank you

    It was a different
  • Just to bring this up to date. Solicitor confirms HR wrong on self employed issue and as such there should have been a meeting with Head and Governors first. Also I can take HR to court. School now has 2 weeks to decide what they want to do? On the criminal record issue, there is no legislation which would stop me from worker as a caretaker as the offence has no relevance to the position. There is some fantastic information out there, we just have to ask and look. Never be afraid of HR.
    Will post when know more,
    thank you
